NOTICE OF SALE 108.5 ACRES PLEASANTS COUNTY
The undersigned, John M. Butler and M. Paul Marteney, having been authorized by the Circuit Court of Pleasants County, West Virginia, to sell at public auction at:
10:00 a. m. oáclock on May 7, 2018
at the front doors of the Courthouse in Pleasants County, West Virginia, the following tracts of real estate located and being situate in Jefferson District, Pleasants County, West Virginia bounded and described as follows:
FIRST TRACT: BEGINNING at a Gum N 31 14/60 degrees W154 poles to 3 Lyns; thence N 12 degrees E 104 poles to a white oak; thence 14 E degrees 192 poles to a stake; thence N 74 40/60 degrees E 165 poles to a Beech; thence N 77 degrees E 38-1/2 poles to a dogwood S 14 degrees E 53 poles to a pine; thence S 76 degrees W33 poles to a white oak; thence N 43 degreesW 52 poles to a stake; thence S 45 degrees W 84 poles to a large white oak; thence S 76 degrees W 76 pole to the beginning containing 86-1/2 acres, be the same more or less.
SECOND TRACT: BEGINNING at a stone in the Schultz line corner to A. H. McTaggart; thence with same S 44 degrees E 32 poles to a stone in the Horseneck and Bull Creek Road; thence with said road and binding; thence N. 32 degrees E 12 poles N. 48-1/4 degrees E 14 poles N. 3-1/2 degrees W 22 poles N 58 degrees E 8-1/2 poles N 84 degrees E 29 poles N 45-1/2 degrees E 34 poles N 41-1/2 degrees E 27 poles and 8 links to a stone in the Campbell line; thence with same N44 degrees W 3o poles to a stake; thence S 46 degrees W 127 poles to the beginning containing 22 acres, more or less.
The aforesaid two tracts are adjoining tracts. Tax Map No. 13 Parcels 7 and 8.
The First Tract was conveyed by Sarah E. Ruckman, et vir., to R. G. W. Campbell, by deed dated the 19th day of March, 1875, said deed of record in the office of the aforesaid Clerk in Deed Book 6, at page 335. The aforesaid Second Tract was conveyed to R. G. W. Campbell from Mary A. Ross, et al., by deed dated the 15th day of December, 1896, said deed of record in the office of the aforesaid Clerk in Deed Book 25, at page 328 excepting for the public and Campbell heirs a certain 100 foot by 100 foot cemetery and the right of way for ingress, egress and regress.
The net acreage is 1o8.5 by calculation but is sold as acreage more or less.
TERMS OF SALE: Cash deposit of $5,000.00 in hand on day of sale, balance within 30 days of sale which forfeits if buyer is unable to perform and upon such other terms to be announced at time of sale; any backup bidder will be noted and contacted to have a right of first refusal at the successful bid price upon successful bidder failing to perform. Any unpaid real estate taxes to be prorated at closing. Title search is buyers responsibility to be conducted before closing. The Sellers will specially warrant title to this property.
The sale may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or posted notice. Any sale may be conducted or adjourned by the designated agent or attorney of the undersigned. The undersigned are fully vested with the authority to sell said property by order of the Circuit Court of Pleasants County W.Va. in Civil Action No. 15-C-6.
