NOTICE OF TRUSTEE’S SALE
In execution of the deed of trust, dated February 3, 2010, from Amanda D. Phillips and Terence L. Phillips, II to Gary R. Mills and Stephen M. Feola, as trustees, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5038, at page 3187, the undersigned trustee will offer for sale at public auction on October 24, 2018, at 10:15 a.m. at the Main Street entrance of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, all those certain tracts or parcels of land situated in Shady Spring District, Raleigh County, West Virginia and more particularly bounded and described as follows:
TRACT ONE
(TAX MAP 400-1, PARCEL 31.1):
Being a part of Lot No. 7 of the subdivision of Cherry Tree Tract, owned F. H. Lynch, as the same appears on a map of said subdivision, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 8, at Page 9, which said part of Lot No. 7 hereby conveyed, being more particularly bounded and described as follows:
BEGINNING at a point on the Blue Jay 6 Road at the common corner of Lots 6 and 7 of said subdivision; thence N. 11deg. 30′ E. 1220 feet to the rear line of Lot No. 7; thence along the northern edge of Lot No. 7, N. 83deg. 21′ W. 90 feet to a point; thence S. 11deg. 30′ W. approximately 1225 feet to the northern edge of the Blue Jay 6 Road; thence in an easterly direction along the northern edge of the Blue Jay 6 Road to the point and place of beginning.
TRACT TWO
(TAX MAP 400-1, Parcel 31.3):
Being a part of Lot No. 7 of the subdivision of Cherry Tree Tract, owned by F. H. Lynch, as the same appears on a map of said subdivision, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 8, at Page 9, which said part of Lot No. 7 hereby conveyed, being more particularly bounded and described as follows:
BEGINNING at a point on Blue Jay 6 Road, which is the southwest corner of a tract of land now owned by Stennie B. Lilly and Jacqueline L. Lilly, his wife (being property which was conveyed to Stennie B. Lilly and Jacqueline L. Lilly, his wife, by deed dated the 26th day of September, 1972, from Goldie Lilly Skaggs (formerly Goldie Lilly) and Dorsey A. Skaggs, her husband, which deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 578, at page 258): thence with the boundary line of the property now owned by Stennie B. Lilly and Jacqueline L. Lilly, N. 11deg. 30′ E. approximately 1,225 feet to the back line of Lot No. 7, which is also a line of S. Griffith; thence with the back line of Lot No. 7, N. 83deg. 21′ W. 35 feet to a stake; thence parallel to the first call and 35 feet therefrom, S. 11deg. 30′ W. approximately 1,250 feet to a stake on the northern edge of Blue Jay 6 Road; thence in an easterly direction and with the right of way line of Blue Jay 6 Road approximately 35 feet back to the point and place of beginning.
And being the same property conveyed unto Amanda D. Phillips and Terrance L. Phillips, II, by deed dated the 3rd day of February, 2010, which deed is not yet recorded, but shall be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to this Deed Of Trust.
This conveyance is subject to all reservations, exceptions, limitations, restrictions, and conditions contained in all former conveyances of said property or any part thereof, excepting those pertaining to race, color or creed.
The deed of trust states that the address of this real estate is 430 Blue Jay Six Road, Cool Ridge, West Virginia 25825.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated September 6, 2018, of record in said Clerk’s Office in Book 5068, at page 2931.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
