Activity:
To operate and maintain an existing wastewater collection system and an existing 2.5 million gallons per day wastewater treatment plant. These facilities are to serve a population equivalent of approximately 25,000 persons in the North Beckley Public Service District, and environs, and discharge treated wastewater through Outlet No. 001 to Cranberry Creek, approximately 1.6 miles from its mouth, of Piney Creek of the New River of the Kanawha River. An antidegradation review was conducted for Outlet No. 001. Tier 1 protection is afforded for the uses specified in Title 47, Series 2, Section 6. To accept nondomestic wastewater from Beckley West Maintenance Garage, Raleigh County Solid Waste Authority, Beckley Garbage Disposal, Wal-Mart No. 1351, Raleigh County Maintenance Headquarters, Little General BP #2075, Heritage Equipment, Inc., Lewis Nissan, Oak Hill Garbage Disposal Inc, Southern Soil Conservation District, and MAC Auto Enterprises, Inc. for subsequent treatment and disposal. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be land applied, provided that the sewage sludge shall not be applied in a manner that exceeds the agronomic or lifetime loading rates. These land application site(s) meet all other regulatory standards and are identified as follows: Fink Brammer (Paul D. Fink, Jr.) located on Egeria Road, Flat Top, WV; Fink Massie Bottom Farm (Paul D. Fink, Jr.) located on Elizabeth Branch Road, Flat Top, WV; Fink Massie Top Farm (Paul D. Fink) located on Elizabeth Branch Road, Flat Top, WV; Fink McBride (Paul D. Fink), located on Egeria Road, Flat Top, WV; Paul D. Fink, Jr. located on Egeria Road, Flat Top, WV; Kochinsky Farm (Kenneth Kochinsky) located on Farley Branch Road, Cool Ridge, WV; Fink Amick Farm (Paul D. Fink) located on Egeria Road, Flat Top, WV; Buzz McCormack Farm (Kenneth R. McCormack) located on Abraham Road, Bragg, WV, Michael Fink Farm (Paul Fink) located on Egeria Road, Flat Top, WV, and Dennis Lilly Farm located on Elizabeth Branch, Flat Top, WV. Also, sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.

Compliance with the terms and conditions of the permit shall be attained through Administrative Order No. 8632, issued the 31st day of October 2016.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins October 29, 2018 and ends November 28, 2018.
Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days.
