NOTICE OF SUCCESSOR
TRUSTEE’S SALE

Notice is hereby given that by virtue of the following deeds of trust:
Deed of Trust dated November 14, 2014 made by J&B Investments, LLC, to Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Trust Deed Book No. 274, at Page 700, Christopher J. Plybon having been appointed as Successor Trustee by Notice of Substitution of Trustee Under Deed of Trust recorded in the aforesaid Clerk’s Office in Trust Deed Book 291, at Page 745.
AND
Credit Line Deed of Trust dated July 28, 2015 made by J&B Investments, LLC, to Alan H. Larrick, Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Trust Deed Book No. 278, at Page 170. Said Credit Line Deed of Trust was modified by Modification of Deed of Trust dated July 21, 2017, recorded in the aforesaid Clerk’s Office in Trust Deed Book 287, at Page 209, Christopher J. Plybon having been appointed as Successor Trustee by Notice of Substitution of Trustee Under Deed of Trust recorded in the aforesaid Clerk’s Office in Trust Deed Book 291, at Page 739.

Default having been made in the payment of the obligations secured by such deeds of trust, the undersigned, Christopher J. Plybon, Successor Trustee, having been required to do so by Community Trust Bank, Inc., the beneficiary of such deeds of trust and holder of the obligations secured thereby, and having full and absolute power and authority in the premises, will on the 29th day of November, 2018, at 1:30 p.m. Eastern Time, offer for sale and sell at public auction, for cash to the highest bidder, at the main front door of the Courthouse of Summers County, at 120 Ballengee Street, Suite 106, Hinton, West Virginia, the following described property:
The following described real estate situate in Jumping Branch District, Summers County, West Virginia, more particularly described as follows:
BEGINNING on a large R.O. in the fence, the same bears N53-28E 19.27 feet from the center of Jumping Branch and is a corner of Sarah Farley; thence S53-28W 19.27 feet to a point in the center of the aforesaid Jumping Branch; thence with the center of said Branch three calls N51-027W 225.66 feet; thence N6-42E 40.58 feet; thence N41-13E 292.89 feet to a point in the center of said Jumping Branch; thence leaving said Branch S42-26E 409.57 feet in all to an I.P. on the westerly R/W of W.Va. Secondary Route 3/2 (passing an iron rod at 67.00 feet and an apple tree at 195.78 feet); thence with said road S17-49W 90.709 feet to an I.P. the same being a corner to Sarah Farley; thence leaving the road and running with the fence and Farley N57-25W 124.12 feet to the corner of the fence; thence S29-52W 102.97 feet to the corner of the fence; thence N81-15W 102.97 feet to the beginning, containing 2.41 acres, according to survey of Hamilton K. Sharpe Associates, dated April 8, 1982.

And being the same property acquired by J & B Investments, LLC, by deed dated the 10th day of November, 2014, from Kathlyn Cozart, individually, Joseph S. Cozart, II, individually, Hinton LTD, an Ohio limited partnership qualified as a foreign limited partnership to do business in the State of West Virginia, to be recorded in the Office of the Clerk of the County Commission of Summers County, West Virginia, prior to or simultaneously herewith.

The Property is commonly known as HC 85 Beagle Club Road, Jumping Branch, WV 25969-9801.

TERMS OF SALE:
1. Cash in hand paid on the day of sale.
2. The sale is made “where is, as is” with no warranty whatsoever.
3. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
4. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever, including, without limitation, the liens for ad valorem real estate taxes for year 2018 and following.
5. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code.
6. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Trustee, the Beneficiary, or any other person or entity.
7. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.
