TRUSTEE’S SALE
Notice is hereby given that by virtue of the following deed of trust:
Deed of Trust dated March 3, 2017 made by J&B Investments, LLC, to Alan H. Larrick Trustee, for the benefit of Community Trust Bank, Inc., which deed of trust is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book No. 5064, at Page 8312, Christopher J. Plybon having been appointed as Successor Trustee by Notice of Substitution of Trustee Under Deed of Trust recorded in the aforesaid Clerk’s Office in Trust Deed Book 5068, at Page 2703.
Default having been made in the payment of the obligations secured by such deed of trust, the undersigned, Christopher J. Plybon, Successor Trustee, having been required to do so by Community Trust Bank, Inc., the beneficiary of such deed of trust and holder of the obligations secured thereby, and having full and absolute power and authority in the premises, will on the 29th day of November, 2018, at 11:00 a.m. Eastern Time, offer for sale and sell at public auction, for cash to the highest bidder, at the main front door of the Courthouse of Raleigh County, at 215 Main Street, Beckley, West Virginia, the following described property:

A tract or parcel of land being located in the vicinity of Beaver, Shady Spring District, Raleigh County, West Virginia, and being more particularly described as follows:
Beginning at a 5/8-inch rebar with cap, set, on the common line of the northerly right of way line of Little Vine Drive, West Virginia County Route 119/20 (old Giles, Fayette and Kanawha Turnpike), Colon D. Richmond and Janice Richmond; thence with the common lines of the northerly right of way line of Little Vine Drive, Colon D. Richmond and Janice Richmond the following two (2) calls: S 75deg. 48′ 17″ W 34.78 feet to a point; S 70deg. 22′ 59″ W 52.04 feet to a 5/8-inch rebar with cap, set, on the common line of the northerly right of way line of Little Vine Drive, Colon D. Richmond and Janice Richmond; thence leaving the northerly right of way line of Little Vine Drive and with a new line running through Colon D. Richmond and Janice Richmond, N 16deg. 53′ 30″ W 81.39 feet to a 5/8-inch rebar with cap, set, on the common line of Kay Gaigall, Colon D. Richmond and Janice Richmond; thence with the common line of Kay Gaigall, Colon D. Richmond and Janice Richmond, N 76deg. 23′ 57″ E 59.39 feet to a 5/8-inch rebar with cap, set, on the southerly right of way line of Ritter Drive, United States Route 19 and West Virginia State Route 3, said rebar being a common corner of Kay Gaigall, Colon D. And being the same property acquired by First Property Buyers, Inc., by deed dated the 12th day of January, 2017, from Colon Douglas Richmond and Janice Richmond, recorded in the County Clerk’s Office of Raleigh County, West Virginia, in Book 5064, at Page 3395, and by Deed of Correction dated January 19, 2017, of record in the aforesaid Clerk’s Office in Book 5064, at Page 6001.

TERMS OF SALE:
1. Cash in hand paid on the day of sale.
2. The sale is made “where is, as is” with no warranty whatsoever.
3. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
4. Subject to any and all assessments and taxes against said property, and all matters of record in the aforesaid Clerk’s Office senior in priority to the deed of trust under which this sale is being made, including without limitation all prior liens and encumbrances of any nature whatsoever, including, without limitation, the liens for ad valorem real estate taxes for year 2018 and following.
5. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code.
6. If the sale is set aside, the purchaser at such sale may be entitled to only a return of the amount paid less any applicable fees and costs and shall have no further recourse against the Trustee, the Beneficiary, or any other person or entity.
7. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof.
