These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the West Virginia Community Action and Development of the West Virginia Department of Commerce.
REQUEST FOR
RELEASE OF FUNDS
On or about December 3, 2018 the West Virginia Department of Commerce will authorize the West Virginia Community Action and Development (WVCAD) to submit a request to HUD for the release of Community Development Block Grant Disaster Recovery (CDBG-DR) funds under the Disaster Relief Appropriations Act of 2016 (Pub. L. 114-223 enacted September 29, 2016, Pub. L. 114-254, enacted January 18, 2017, Pub. L. 115-31 enacted May 5, 2017, and Pub. L. 115-141 enacted March 23, 2018) to undertake a project known as Slum and Blight Removal Program, and a project known as Bridge Home Program, for the purpose of demolition of slum and blighted residential and business structures, and replacement or repair of private bridges that were damaged by the June 2016 flood event. For the Slum and Blight Removal Program, no new structures are being built. Demolition materials will be removed and disposed at approved landfill facilities. No on-site disposal of demolition materials will occur. After demolition, each location will be graded to approximate original contour and the surface seeded with grass and overlain with straw. Outbuildings, garages, and storage buildings will also be demolished at each location. For the Bridge Home Program, damaged and unusable bridge materials will be removed, and bridge repair or replacement will occur.
Under 24 CFR 58.15 (Tiering) and 24 CFR 58.32 (Project Aggregation), WVCAD will utilize a tiered approach for combining similar work into geographic as well as functional aggregation packages when conducting the environmental review. The Broad Review, or Tier I Review, has been completed for each of the 12 affected counties and it has been determined that the project will not result in a significant impact on the quality of the human environment. Applying the tiering rule provides WVCAD the ability to separate individual project site work into aggregate categories of work having similar geographic and/or functional environmental attributes. A “site specific” or Tier II” review will be done on each subject property before using CDBG-DR funds for program activities. This notice is for the 12 affected counties of:
Kanawha, Greenbrier, Clay, Nicholas, Fayette, Jackson, Lincoln, Webster, Monroe, Pocahontas, Roane, Summers
Estimated funding includes $5,875,000 for the Slum and Blight Program; $2,080,000 for the Bridge Home Program.
FINDING OF
NO SIGNIFICANT IMPACT
The WVCAD has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at WVCAD offices, located at the Capital Complex, 1900 Kanawha Boulevard East, Building 3, Floor 7, Charleston, WV. The ERR is available for review at this location, and may be examined or copied weekdays 9:00 a.m. to 5:00 p.m.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the WVCAD. All comments received by December 3, 2018 will be considered by the WVCAD prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL
CERTIFICATION
The WVCAD certifies to HUD that Jennifer Ferrell in her capacity as Interim Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the WVCAD to use Program funds.
OBJECTIONS TO
RELEASE OF FUNDS
HUD will accept objections to its release of funds and the WVCAD’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVCAD; (b) the WVCAD has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Jill K.
