The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 25, 2014, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5056, at Page 1832, Clayton A. Brown, Jessie D. Brown and Heather Izora Smith did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
Wednesday, January 9, 2019,
at 12:36 p.m.

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Town District, Raleigh County, West Virginia, and more particularly described as follows:
The surface together with all improvements thereon and appurtenances thereunto belonging of that certain tract or parcel of land situate in Town Tax District, Raleigh County, West Virginia, on the waters of North Sand Branch, and being more particularly described as follows:
BEGINNING at a stake in the southern right-of-way line of the public road between Maple Fork and North Sand Branch; thence S. 64deg. 43′ W., 149.10 feet to the two sourwood stumps on the top of a cliff; thence with the top of the cliff N. 16deg. 55′ W., 70 feet to a stake; thence N. 9deg. 04′ W., 120 feet to a stake in the said southern right-of-way line of the public road; thence with the public road S. 41deg. 38′ E., 132.30 feet to a stake; thence S. 74deg. 40′ E., 88.70 feet to the point of beginning, containing .26 acre, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 487 Beechview Road, Mount Hope, WV 25880.

AND BEING the same real estate which was conveyed to Clayton A. Brown and Jessie D. Brown, by Deed dated January 12, 1991, from Nellie Sharon Brown Thomas and Lawrence Thomas, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Microfilm Roll 6 at Page 1665. FURTHER BEING the same real estate which was conveyed to Clayton A. Brown, Jessie D. Brown and Heather Izora Smith by Deed dated June 17, 1993, from Clayton Allen Brown and Jessie Derene Brown and recorded in the aforesaid Clerk’s Office in Microfilm Roll 47, at Page 1146.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
