NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated September 30, 2009, from Chesley Ray Foley and Lisa Lynn Foley to Casie McGee, Trustee, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia on Roll No. 5037, at page 1999, and Roll No. 5037, at page 3034, securing a promissory note in the principal amount of $80,127.35, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Raleigh County Courthouse in Beckley, West Virginia on March 28, 2019 at 2:15 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the surface of Tract No. 8, a 4.82 acre surface tract, together with the improvements thereon and appurtenances thereunto belonging, located on Fire Trail Drive off of C & O Dam Road (Raleigh County Route 19/13), near Daniels, Shady Spring District, Raleigh County, West Virginia, more particularly bounded and described as follows:
BEGINNING at a point on the easterly line of Fire Trail Drive, a 40 foot street, said hub the southerly front corner of Tract No. 7 owned by W. Gaston Wisen and William E. Wisen, (said hub located S. 43deg.-20′ E. 91.76 feet from corner No. 32 as shown on an entitled map of 427.84 Acre Tract Shady Spring District, Raleigh County, West Virginia Owned by Mrs. Dollie S. Lynch of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map File 1-18, thence leaving said street line and with the line of said Tract No. 7, N 67deg. 06′ E 1,779.18 feet to a hub found on the line of Lorraine Lilly and the southwesterly corner of the aforesaid Tract No. 7; thence leaving Tract No. 7 and with the said Lilly line for the following two (2) calls: S 67deg. – 06′ E 90.59 feet to a pipe corner found by a fence corner; thence S 84deg. – 38 1/2′ E 109.74 feet to a pipe corner found on the said Lilly line; thence leaving said Lilly on a new line, S 67deg. – 26 1/2′ W 1,203.67 feet to a hub found at the northeasterly corner of Tract No. 11, owned by Dexter E. and Robin G. Burgess; thence partly with the back line of Tract No. 11 (245.88 feet), and partly with the line of Tracts No. 10, owned by Kenneth Q. Nixon, (245.15 feet) and No. 9, owned by Carl E. and Loretta E. Holcomb (252.60 feet) for a total line of S. 66deg. 31′ W 746.63 feet to a pipe corner found, the westerly front corner of the aforesaid Tract No. 9 and on the aforesaid street line, thence leaving Tract No. 9 and with said street line, N 17deg. – 26′ W 118.04 feet to the BEGINNING and containing 4.82 acres, surface, more or less.
Being the same property conveyed from Jack Charles Breeden, Jr. to Chesley Ray Foley and Lisa Lynn Foley, his wife, by Deed dated July 20, 2000, of record in the aforesaid Clerk’s office on Roll No. 5002, at page 7818.
Terms of the sale: Ten percent nonrefundable cash deposit at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
