The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated February 11, 2013, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50504729, in Book No. 5050, at Page 4729, Tara L. Rubin and Brett T. Rubin did convey unto Mike Day and Carl W. Roop, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated March 8, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association, to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on
April 12, 2019 at 12:30 p.m.
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
The surface, together with the improvements thereon and appurtenances thereunto belonging of that certain lot or parcel of land, situate and being in the Hall Addition, to the City of Beckley, Raleigh County, West Virginia, and being Lot No. Two (2) of said Hall Addition as the same is set forth and designated on that certain map entitled “Plot plan of Lot No. 2, Hall Addition, Beckley, WV owned by William and Beatrice Binderman, Scale 1″ = 30′,. PH Wilson, Eng., Sept 2, 1947”, which map is attached tot hat certain deed from Arthur E. Chambers and Beatrice E. Chambers, his wife, to William Binderman and Beatrice Binderman, his wife, Dated the 8th day of September, 1947, which said deed and map is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 249, at Page 376, to which said map reference is hereby expressly made for a more particular description of said lot or parcel of real estate, and which said Lot No. Two hereby conveyed is more particularly bounded and described as follows:
BEGINNING at a stake of the western edge of Harper Road, being the northeastern corner of said Lot 2 and the southeastern corner to Lot 1 to the north thereof; thence along the western edge of said road, S. 26 degrees 15′ W. 51.36 feet to another stake on the western edge of said road being the southeastern corner of said Lot 2 and the northeastern corner to Lot 3 to the south thereof; thence along the division line between said Lots 2 and 3, N. 67 degrees 06′ W. 180 feet to a stake, being the southwestern corner of Lot 2 and the northwestern corner of said Lot 3; thence N. 22 degrees 54′ W. 51 feet to another stake; being the northwestern corner of said Lot 2 and the southwestern corner of said Lot 1; thence along the division line between said lots 1 and 2, S. 67 degrees 06′ E. 183 feet to the point and place of beginning.

And being the same property conveyed to Brett Rubin and Tara Rubin, his wife, by deed dated the 17th day of August, 2009, from Brian Williams and Donna Williams, his wife, and recorded in the Office of the County Commission of Raleigh County, West Virginia, in Book 5036at page 9836.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1544 Harper Road, Beckley, WV 25801.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
