COMMISSIONER’S JUDICIAL
SALE OF VALUABLE
REAL ESTATE

Notice is hereby given that the undersigned, GAVIN WARD, SPECIAL COMMISSIONER, by virtue of that certain Order entered the 1st day of May, 2019, in that certain Civil Action now pending before the Circuit Court of Fayette County, West Virginia, styled, Cleta Blevins, Petitioner, v. Dorothy M. Lampley, Respondent, Civil Action No. 18-C-147, the said Court having directed the Special Commissioner to make sale of the real estate that is the subject of said Civil Action, the undersigned Special Commissioner will offer for sale and sell at public auction to the highest bidder on the 21st day of May, 2019 at 10:00 a.m., at the front door of the Fayette County Courthouse in the Town of Fayetteville, Fayette County, West Virginia, the real estate or premises that is the subject of said Civil Action being and consisting of the following located in New Haven District :
BEGINNING at an iron pin in the center of a twenty-four foot street in Kaymoor No. 2 Camp of New River and Pocahontas Consolidated Coal Company, a New Jersey corporation, and located S 450 E 51.00 feet from the most southerly corner of House 262 on lot herein described; thence, with the center of said street, N 49 27 W 93.57 feet to an iron pin located S 49 27 E 86.49 feet from an iron pin, the southeast corner of a 0.42 acre lot on which is located House 264; thence leaving said street, N 40 33 E 201.75 feet to a stake; thence S 49 27 E 95.98 feet to a stake; thence S 41 14 W 201.76 feet to the beginning, containing 0.44 acres more or less as shown on a map entitled “New River & Pocahontas Consolidated Coal Company, Minden Division, Dec. 7 1955, Scale 1″ = 100′, Legend, Surface area at Kaymoor No. 2 Camp to be conveyed to Arthur Blevins, et ux”.

AND BEING the same property Arthur Blevins and Nannie Mae Blevins, acquired from the New River & Pocahontas Consolidated Coal Company by deed dated December 9, 1955 and recorded in the aforesaid Clerk’s Office in Deed Book 196 at page 207. The Parties involved in this Civil Action are heirs of Arthur & Nannie Blevins.

The sale is subject to and conditioned upon confirmation by the Circuit Court of Fayette County.
Title shall be conveyed by the Special Commissioners with covenants of special warranty. The property taxes will be paid through the 2018 tax year. All taxes thereafter assessed against the said property shall be paid by the Purchaser. The aforesaid sale may be adjourned from time to time as the undersigned Special Commissioner deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof. The subject property will be sold in AS IS condition. The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS OF SALE: 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} cash in hand on day of sale, balance due at closing which shall occur within 30 days of confirmation of the sale by the Circuit Court of Fayette County. In the event that the Purchaser fails to consummate the transaction, the 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down shall be forfeited.
