NOTICE OF TRUSTEES SALE

In execution of the deed of trust, dated March 19, 2014, from Deborah A. Froy and William James Froy, Jr. to Gary R. Mills, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1272, at page 265, the undersigned trustee will offer for sale at public auction on June 13, 2019, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all those certain tracts or parcels of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, known as Lot 2, Section 970, of the Oak Grove Land Association, City of Bluefield, West Virginia, as shown on microfilm plat number 1708A and which property is more particularly bounded and described as follows;

BEGINNING a point on the eastern line of Bland Road (formerly Memorial Boulevard) 110 feet in a southeasterly direction from the point of intersection of the southern line of Shady Avenue with said eastern line of Bland Road, said point marking the southernmost corner of Lot 1; in said Section 970 thence with the southern line of Lot 1, N. 58o, 15′ E. 284.08 feet to a said point, corner to Lots 1,2,3 and 16k, in said Section 970; thence leaving said Lot 1 and with the westernmost line of said Lot 3, S. 14o 27′ E. 146.28 feet to a point in the northern line of Oak Grove Avenue; thence with said line of Oak Grave Avenue on a curve to the left with a radius of 843.96 feet chord bearing S. 67o 10′ W. 229.52 feet to the point of Juncture of said line of Oak Grove Avenue with said eastern line of Bland Road; thence with said line of Bland Road N. 39o 17′ W. 105.0 fee to the point of BEGINNING;

And being the same real estate conveyed to Deborah Froy by deed Patricia Currence dated March 11,2014, which deed is to be recorded in the Mercer County Clerk’s office simultaneously herewith.

The deed of trust states that this real estate currently has an address of 2709 Bland Road, Bluefield, West Virginia 24701.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated May 10, 2019, of record in said Clerk’s Office in Trust Deed Book 1372, at page 749.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any warranty, expressed or implied. The improvements on the real estate will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
