TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 20, 1995, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 1410, at Page 740 and rerecorded in Deed of Trust Book 1416, at Page 56, James F. Jeffers and Lillian G. Jeffers did convey unto John Ballengee and Bernard T. Nibert, II, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on September 18, 2019, at 1:32 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Gideon District, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of ground, together with all buildings thereon and all appurtenances thereunto belonging, situate in the City of Huntington, Cabell County, West Virginia, known and designated on the revised map of the City of Huntington, made by L. W. Leete, Civil Engineer, which map was filed in the Cabell County Court Clerk’s Office, West Virginia, on the 31st day of December, 1903, as part of Lot Number One (1), Block 283, and being more particularly described as follows: BEGINNING at a point in the north line of Fifth Avenue 83 feet easterly from the point of intersection of the said north line of Fifth Avenue with the east line of Thirtieth Street; thence easterly and with the said north line of Fifth Avenue 82 feet to the west line of city Alley; thence northerly and with the west line of said city alley 35 feet to a point; thence westerly and parallel with the north line of said Fifth Avenue 82 feet to a point; thence southerly and parallel with the east line of Thirtieth Street, 35 feet to the point of BEGINNING. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3004 Fifth Avenue, Huntington, WV 25702. AND BEING the same real estate which was conveyed to James F. Jeffers and Lillian G. Jeffers, by Deed dated April 12, 1995, from Jack R. Taylor, Sr. and Helen V. Taylor and Phyllis A. Clauson and Donald W. Clauson, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book, 987 at Page 724. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
