NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 27, 2007, executed by Borrowers, Carol Raymond Taylor and Donna May Taylor, to Richard A Pill, Esq., the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2197, at Page 152. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 442 Johns Creek, Milton, WV 25541. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 23, 2019, of record in the Clerk’s Office in Book 400, Page 318. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. LESS AND EXCEPT A Tract of land situate on the Waters of Mill Creek, a Tributary of the mud River, on Johns Creek Road, Route 13, East side, Grant District, Cabell County, North of Milton, West Virginia, Tax Map 8, parts of Parcels 35, 35.2 and 35.3, more particularly described as follows: Beginning on a Bridge over Mill Creek, on Johns Creek Road, Route 13; a South West corner to Lunsford Land, thence N. 16 degrees 13 feet E. 256.40 feet with the East side of Johns Creek Road along the West side of Mill Creek; thence N. 3 degrees 10′ W. 495.41 feet with the East side of Johns Creek Road, Route 13; thence N. 8 degrees 48′ E. 169.08 feet with the East side of Johns Creek Road, Route 13; thence N. 9 degrees E. 102.79 feet with the East side of Johns Creek Road, Route 13; thence N. 0 degrees 30′ E. 126.00 feet with the East side of Johns Creek Road, Route 13 to a culvert at Taylor land; thence due North 53.00 feet to a point witness by a found an iron pen on the West side of the road; thence S 84 degrees 20′ E. 118.68 feet with Taylor North line to an iron pen on the East side of the Creek; thence S. 9 degrees 30′ W. 103.49 feet on the original line; thence S. 45 degrees 07 W. 92.40 feet crossing Mill Creek to East side of Johns Creek Road, Route 13; thence S. 4 degrees 45′ W 200.00 feet running between Mill creek and the Johns Creek Road; thence S. 4 degrees 45′ W. 167.66 feet running between Mill Creek and the Johns Creek Road; thence S 4 degree S. 07 W. 495.00 feet running between Mill Creek and the Johns Creek Road; thence S. 20 degrees W. 262.00 feet running between Mill Creek and the Johns Creek Road to the point of beginning, containing 1.31 acres, more or less, as surveyed by Dallas Lovejoy L.L.S. 193, Milton, West Virginia, as shown on a Map titled, Property Plat For Larry and Carla Leadman, dated December 20, 1991. Being the same property conveyed to Carol Raymond Taylor and Donna May Taylor by the Deed dated November 28, 1966 and recorded in Deed Book 649 at Page 557 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
