NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated April 5, 2013, from Dextor Martin and Kathryn Martin to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Randolph County, West Virginia in Trust Deed Book No. 508, at page 584, and Trust Deed Book No. 516, at page 1, securing a promissory note in the principal amount of $38,506.99, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Randolph County Courthouse in Elkins, West Virginia, on February 7, 2020 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain tract or parcel of real estate containing 1.09 acres, more or less, located on the waters of the Tygart Valley River, situate in Huttonsville District, Randolph County, West Virginia, together with any and all improvements situate thereon and any and all appurtenant easements which may benefit same.

Beginning at a point at the intersection of rights of way of WV Secondary Route 250/3 and an existing road, a proposed 20′ right of way, from which a found 1/2″ iron pipe bears South 87 degrees 00 minutes West 311.26 feet; thence with the proposed 20′ right of way North 71 degrees 29 minutes West 42.39 feet to a point on the right of way of the 20′ road; thence North 60 degrees 54 minutes West 38.25 feet to a point on the right of way of the 20′ road; thence North 53 degrees 44 minutes West 33.39 feet to a point on the right of way of 20′ road; thence North 40 degrees 41 minutes West 49.71 feet to a point on the right of way of the 20′ road; thence North 32 degrees 05 minutes West 66.00 feet to a point on the right of way of the 20′ road; thence North 34 degrees 17 minutes West 29.90 feet to a set 5/8″ rebar on the right of way of the 20′ road; thence North 38 degrees 07 minutes West 144.66 feet to a set 5/8″ rebar on the right of way of the 20′ road; thence North 11 degrees 15 minutes East 20.36 feet to a point on the right of way of the 20′ road; thence North 48 degrees 11 minutes East 159.06 feet to a set 5/8″ rebar on the south side of the road; thence South 40 degrees 07 minutes East 258.92 feet to a point on the western right of way of WV Secondary Route 250/3, passing a set 5/8″ rebar at 246.31 feet; thence with the right of way of Route 250/3; thence South 45 degrees 19 minutes West 53.02 feet to a point on the right of way of Route 250/3; thence South 35 degrees 00 minutes West 42.42 feet to a point on the right of way of Route 250/3; thence South 25 degrees 52 minutes West 28.71 feet to a point on the right of way of Route 250/3; thence South 10 degrees 58 minutes West 22.47 feet to a point on the right of way of Route 250/3; thence South 25 degrees 50 minutes East 50.21 feet to a point on the right of way of Route 250/3; thence South 46 degrees 54 minutes East 31.37 feet to the beginning, containing 1.09 acres as surveyed by A-Tech Land Surveying LLC and as shown on the plat as Lot C.

Being the same property conveyed from Connie Sue Yokum to Dextor Martin and Kathryn Martin by Corrective Deed dated October 4, 2012, of record in the aforesaid Clerk’s office in Deed Book No. 559, at page 376.

Terms of the sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
