NOTICE TO POSSIBLE CLAIMANTS OF $4,522.00 IN UNITED STATES CURRENCY and 1 WINCHESTER MODEL 1300 PUMP SHOTGUN (L2312251), 1 DELTON 5.56 ASSAULT RIFLE (DTI-S107982), and 1 SMITH & WESSON 4046 40 CAL PISTOL (TVB0924) SEIZED CORPORAL B.W. COGAR OF THE RANDOLPH COUNTY SHERIFF’S OFFICE ON NOVEMBER 10, 2019.

On November 10, 2019, Cpl. B.W. Cogar of the Randolph County Sheriff’s Office seized $4,522.00 in United States currency and one (1) Winchester Model 1300 Pump Shotgun (L2312251), one (1) Delton 5.56 Assault Rifle (DTI-S107982), and one (1) Smith & Wesson 4046 40 Cal Pistol (Tvb0924) all of which was found in a motor vehicle which was operated by Joseph Ray Hall and was involved in a single vehicle accident which resulted in the death of Joseph Ray Hall.

The Petitioners believe that the said $4,522.00 in United States currency and said firearms are subject to seizure and forfeiture, pursuant to the West Virginia Contraband Forfeiture Act (W.Va. Code sections 60A-7-703 and 704), and that said $4,522.00 and said firearms were used to facilitate the sale, receipt, possession, manufacturing, possession with intent to deliver, and/or delivery of controlled substances in violation of Chapter 60A of the Code of West Virginia.

Petitioners seek an Order from the Circuit Court of Randolph County, West Virginia that the said $4,522.00 in United States Currency and the said firearms be forfeited to the State of West Virginia and the Randolph County Sheriff’s Office and ownership of said property be vested in the State of West Virginia and the the Randolph County Sheriff’s Office; that, thereafter, it be disposed of according to law.

To any claimant of the within described property: You have the right to file an answer to this petition setting forth your title in, and right to possession of, the property within 30 days of the service hereof. If you fail to file an answer, a final order forfeiting the property to the State will be entered, and such order is not subject to appeal

Any claimant to the above referenced property has a right to file a claim on or before February 26, 2020. Any claim must clearly state the identity of the claimant and an address where legal process can be served upon them and must be filed with the Circuit Clerk of Randolph County, West Virginia.
