NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated February 20, 2019, from Crystal Ann Taylor, Lucas Ray Taylor and Robert Alan Summerfield to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Randolph County, West Virginia in Trust Deed Book No. 573, at page 363, securing a promissory note in the principal amount of $53,609.42, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Randolph County Courthouse in Elkins, West Virginia, on March 4, 2020 at 1:00 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, a tract or parcel of land, together with the improvements thereon and appurtenances thereunto belonging, situate on Cardinal Drive, a private access road on the west side of the Adolph Road (Randolph County Route 46), 1.4 miles north of Mill Creek, West Virginia, on the waters of the Right Fork of Mill Creek, Huttonsville District, Randolph County, West Virginia, more particularly described as follows:
Beginning at a point in the center of Mill Creek, a corner to Dayton L. Taylor (Deed Book 454 at page 583) and Glenn B. Taylor (Deed Book 549 at age 316), thence with said Dayton L. Taylor for a possible short section of line S 64* 07′ E, at 93.44 feet crossing a set 3/4 inch by 36 inch rebar with a 2-3/4 inch diameter orange plastic cap, a corner in line of said Glenn B. Taylor, at 160.90 feet crossing the center a reserved 16 feet road right-of-way, In all 292.09 Feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, stamped L Mallow PS 567 Property Corner (typical), in a wire pasture fence, being on the eastern line of a 16 feet wide road right-of-way to the Melvin Shiflett parcel and described in former Deed Book 520 at page 517 and a corner to Dayton L. Taylor (Deed Book 454 at page 583), thence with said Dayton L. Taylor, said wire fence and the eastern edge of said 16 feet wide road right-of-way S 29* 49′ W, 75.17 Feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, 6.6 feet southwest of a telephone post at a pasture fence corner, a corner to said Dayton L. Taylor and a corner in line of Melvin Shiflett (Deed Book 592 at page 338), from which the base of a found 5/8 inch rebar at a fence corner and a 20 feet west of the center of the Adolph Road bears S 64* 05′ 108.06 feet, thence crossing the end of the 16 feet wide road right-of-way and with said Melvin Shiflett N 64* 09′ W, at 182.80 feet crossing the center of the end of a reserved 16 feet wide road right-of-way, at 220. 84 feet crossing a found 5/8 inch rebar, In All 289.00 Feet to a point in the center of the Right Fork of Mill Creek, a corner to said Melvin Shiflett and a corner to Dayton L. Taylor (Deed Book 454 at page 583), from which a found 5/8 inch rebar at the end of a fence row and 29 feet east of the edge of the creek, bears S 4* 38′ W, 167.95 feet, thence with the center of said Mill Creek and said Dayton L. Taylor for two lines N 26* 57′ E, 53.68 Feet to a point, thence N 28* 44′ E, 21.53 Feet to the Beginning, Containing 21,833 Square Feet or 0.50 Acres, as surveyed in February 2019 by Leon G. Mallow of Leon G. Mallow Surveying Inc., 2000 Piercy Road Montrose West Virginia and as shown on a plat which is made a part of this description;

Subject to an overhead electric power line easement crossing the tract;

Subject to an overhead telephone line easement running along the south line of tract;

Subject to a 16 feet wide road right-of-way through the east end of the tract, for access to the Melvin Shiflett tract and described in Deed Book 520 at page 517;

Subject to the inclusive of the right to use an “existing private road as a means of ingress and egress in and to the parcel” of real estate described by the subject deed of record in Deed Book 319 at page 367; said private road is now designated as Cardinal Drive;

Subject to and reserving a 16 feet wide road right-of-way by Glenn B. Taylor, across the above described 0.50 acre tract, for ingress and egress to the Melvin Shiflett tract, the centerline thereof described by survey as follows:

Beginning at a point in the center of existing driveway, 160.90 feet southeast of the center of Mill Creek and 67.45 feet southeast of a set rebar with plastic cap, thence with the center of said existing driveway for four lines S 89* 29′ W, 14.50 Feet to a point, thence S 72* 24′ W, 35.21 Feet to a point, thence S 52* 56′ W, 31.10 Feet to a point, thence S 39* 32′ W, 17.20 Feet to a point in the line of Melvin Shiflett (Deed Book 592 at page 338), being 38.05 feet southeast of a found 5/8 inch rebar and 106.20 feet southeast of the center of Mill Creek.

Being the same property conveyed from Glenn B. Taylor and Marsha Taylor to Crystal Ann Taylor and Lucas Ray Taylor by Deed dated February 20, 2019, of record in the aforesaid Clerk’s office in Deed Book No. 599, at page 36.
Terms of the sale: Ten percent nonrefundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
