ORDER SCHEDULING TELEPHONIC/MICROSOFT TEAMS MEETING FOR A GUARDIANSHIP HEARING
Pursuant to the April 22,2020 Administrative Order of West Virginia Supreme Court of Appeals relativc to the COVID”19 pandemic, all hearings will be cond,uctedremotely in an effort to protect the health, safety and welfare of the litigants, witnesses, and Court staff and personnel.Accordingly the Court ORDERS as follows:
1. On October 30, 2020, the Petitioner filed a Motion to Continue theNovembcr 5, 2O2O hearing due to being unable to publish service. The hearing is hereby continued.
2, A Guardianship hearing shall be held on Thursday. January 7, 2021.AT1:00 noon.This hearing will be conducted remotely via Microsoft Teams. Attached to this Order, you wiil find instructions, including telephone number and access code to appear via video or call-in for the hearing. You can appear by telephone, smart device or computer. you must call in or access the conference at the designated time to appear for the hearing.
3 If you wish to appear via Teams, you must contact the office of the Court at 1-304-238-1012 or 1-304-2I5-4289 and provide an email address for the Court to send the electronic notice at least forty’eight (48) hours prior tothe day the hearing is scheduled. otherwise, you must appear telephonicaily. (If you appear by phone, you will not be able to see “any exhibits as they are presented to the Court.)
4′ In contested matters where there will be exhibits, or in matters where child support will need to be calculated, it is MANDATORY and you are hereby ORDERED to provide copies of any exhibits you intend to use to the COURTand to the OPPOSING party or their ATTORNEY within frve (5) working days of the schedulecl hearing. This can be accomplished. via U.S. MaiI, or email to [email protected] or
[email protected], or by facsimile transmission to 1-304-238-1020. If you have electronic evidence such as emails or text messages, it will now be necessary to have those matters printed and physically sent to the Court and opposing party. FAILURE TO PROVIDE EXHIBITS AND EVIDENCE IN ACCORDANCE WITH THIS ORDER MAY DELAY YOUR CASE BEING HEARING OR A FINAL DECISION MAY BE MADE WITHOUT THE EVIDENCE YOU WISH TO PRESENT.
5. The Court, may, in its discretion, treat this hearing as a final hearing or for any other purpose. AII parties and counsel should be prepared to proceed. Any request for a continuance must be made in writing and filed with the Circuit Clerk of this Court.
