A Public Hearing for the Board of Zoning Appeals is scheduled for Tuesday, May 4, 2021 in Council Chambers, Weirton City Building, 4:30 P.M. The purpose of this regular meeting is to review the following applications:

a)John Lemal, 43 Highview Circle, requests a variance to permit a ten (10) feet setback in the rear yard for a deck. The City of Weirton Unified Development Ordinance (UDO) Table 2 Development requires Minimum rear setback of thirty (30) feet. Tax Map W40N, Parcel 0150, zoned R-1 Single Family Residential.
b)Ronald Ohalex, 337 Booker Street, requests a variance to permit an accessory structure on a separate lot from the principal structure. The City of Weirton Unified Development Ordinance (UDO) definitions state’s accessory structure is a subordinate structure detached from but located on the same lot as a principal building. The use of an accessory structure must be incidental and accessory to the us use of the principal building. Tax Map W43C, Parcel 0101, zoned R-1 Single Family Residential.
c)Kensington Investment, is requesting a Conditional Use in a R1 District for a retail establishment at 3901 Brightway Street. Conditional uses in an R1, R2, and R3 districts require zoning board approval. Tax Map W42R, Parcel 0402, zoned R-1 Single Family Residential.
d)Kensington Investment, is requesting a variance for a zero (0) feet setback for a 20 ft long by 3.4 ft wide metal awning at 3901 Brightway Street. The awning would be placed on the building and hang over the right of way. Tax Map W42R, Parcel 0402, zoned R-1 Single Family Residential.

Applicants must appear in person; all interested parties may appear in person or be represented by agent or attorneys or submit comments in writing giving reasons for either granting or denying this petition.
