NOTICE IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA WHEREAS, the resignation of Magistrate Mike Woelfel has caused a vacancy in the office of the Magistrate Court in the Sixth Judicial Circuit of West Virginia; and WHEREAS, West Virginia Code 3-10-l(b) provides that the Chief Judge of the Circuit Court shall appoint a temporary successor within thirty (30) days of the vacancy; and pursuant to the current vacancy of Magistrate in the Sixth Judicial Circuit of West Virginia, applications may be made to the Office of the Chief Circuit Judge, Gregory L. Howard Jr., 750 5th Avenue, Suite 215, Huntington, West Virginia 25701 postmarked by August 3, 2021; and WHEREAS, West Virginia Code 3-10-1 also provides that if from any cause a vacancy shall occur in the office of a magistrate, the Chief Judge of the Circuit Court shall issue a directive of election to fill such vacancy in the manner prescribed by law for electing a magistrate of the court in which the vacancy exists, and the magistrate shall be elected for the unexpired term; and WHEREAS, West Virginia Code 3-10-3, as amended, provides that where an unexpired term of office for a magistrate is for a period longer than two years, the vacancy shall be filled by a successor who has timely filed a certificate of candidacy and has been elected in a non-partisan election and qualified to fill the unexpired term; and WHEREAS, at the time of Magistrate Woelfel’s resignation, more than two years remained unexpired in the term of office for Magistrate of the Sixth Judicial Circuit of West Virginia; and WHEREAS, candidates may file for the Primary Election from now until January 29, 2022 at the Cabell County Clerk’s Office located at 750 5th Avenue, Suite 108, Huntington, West Virginia between the hours of 8:30 a.m. and 4:30 p.m. and the filing fee is 1% of the salary. NOW, THEREFORE, I, Gregory L. Howard, Jr., Chief Judge of the Circuit Court of Cabell County of State of West Virginia, under the authority vested in my by the laws of this State, do hereby proclaim and declare that the unexpired term of office for Magistrate of the Sixth Judicial Circuit of West Virginia shall be filled by the voters of Cabell County that constitute the Sixth Judicial Circuit of West Virginia at an election to be held concurrently with the primary election held on the 10th day of May, 2022.
