TO: WV CLEANERS, INC. 330 Wood Lomond Huntington, WV 25704 NOTICE OF SALE Under authority of a certain A Deed of Trust dated June 18, 2014, from WV Cleaners, Inc. to Anthony Marks Trustee, securing Premier Bank, Inc., formerly known as First Bank of Charleston, Inc., in the amount of $2,483,729.98, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2534, at page 277, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated November 14, 2018, and recorded in the aforesaid Clerk’s Office in Trust Deed Book 403, at page 82, will offer for sale at the front door of the Cabell County Courthouse in Huntington, West Virginia, on August 24, 2021, at 1:00 o’clock, the certain real estate conveyed in said Deed of Trust, which is further bounded and described as follows: 2503 WASHINGTON BLVD., HUNTINGTON All those certain lots, pieces or parcels of ground, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Beverly Hill, a copy of which map was recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on the 14th day of December, 1936, in Map Book 3, as Map No. 139, as part of Lot M, Lots N, O, P and Q and a part of a parcel shown on said map as a 15 foot private alley, said parcel of land being more particularly described as follows: BEGINNING at a point in the south line of Washington Boulevard at the easterly corner of Lot Q, as shown on said map; thence with said line, S. 15 53′ W. 100.77 feet to a point in the north line of a 15 foot alley; thence with the said alley line, curving to the left in a southwesterly direction with a radius of 55 feet and with the south line of Lots P & Q and said private alley, 48 feet; thence N 36 47′ ; W. parallel to and approximately 1 foot distance easterly from the wall of the theater building now on the adjoining property, 150.4 feet to a point in the said line of Washington Boulevard; thence with the line, curving to the right in an easterly direction with a radius of 40 feet, a distance of 9.4 feet; thence continuing with said Boulevard line, S 84 44′ E. 154.32 feet to the point of BEGINNING. All those certain lots, pieces or parcels of land situate in the State of West Virginia, Cabell County, Barboursville District, known and designated on a map of SLATER SUB-DIVISION of a part of FARMDALE, a copy of which map was filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on March 19, 1951, in Map Book 5, Page 57, and being a PART OF LOTS NOS. SEVEN (7), EIGHT (8), AND NINE (9), and being more particularly bounded and described as follows: BEGINNING at a “P-K” nail and shiner (set) on the southerly right-of-way line of U. S. Route 60, and marking a corner common to Lots Nos. 6 and 7; thence, leaving the said Lot No. 6, and with the southerly right-of-way line of the said Route 60, North 78 deg 31′ 120.00 ft. to an iron pipe (recovered), marking a corner common to Lots Nos. 9 and 10; thence, leaving the said Route No. 60, and with the said Lot No. 10, South 11 deg. 29′ E. 94.80 feet to an iron pipe (recovered) in the center of a 10 foot easement; thence, leaving the said Lot No. 10, and with the center of the said 10 foot easement, South 74 deg. 59′ W. 120.23 feet to an iron pin and cap (recovered), marking a corner common to the said Lot No. 6; thence, leaving the said 10 foot easement and with the said Lot No. 6 North 11 deg. 29′ W. 102.21 ft. to the BEGINNING, containing 0.271 acre, (11,821 square feet), more or less, as surveyed by Ronald L. Eastham, Registered Professional Surveyor No. 150, on September 26, 1990, and shown on the plat. 1018 CHURCH STREET All that certain piece, parcel or lot of real estate, situate in the Town of Milton, Cabell County, West Virginia, fronting Sixty-Six (66) feet on the South side of Church Street, in said Town of Milton, and extending back Ninety-Six (96) feet to an alley, known and designated on the plan or plat of the said Town of Milton, now appearing of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, as Northerly Ninety-Six (96) feet of Lot Number Thirty-Five (35) in the said Town of Milton. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Trustee herein. TERMS OF SALE Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
