And it appearing by an affidavit filed in this action that even after using due diligence, the plaintiff was unable to discover the residence or whereabouts of the defendant. The defendant was not served, either personally or by way of service upon an appropriate family member, after service was twice attempted by a process server of the county in which the defendant resides or is located. It is ordered that Anthony Mancini do serve upon Dan Ferguson, magistrate, whose address is 750 Fifth Avenue, Huntington, WV 25701, an answer or other defense to the complaint filed in this action on or before October 29, 2021, otherwise judgment by default will be taken against Anthony Mancini at anytime thereafter.
