Bird Drive, Beckley, WV 25801 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at: 254 Industrial Drive, Oak Hill, WV 25901 for an Article 3 permit for the surface disturbance of approximately 66.84 acres in order to amend the permit area by adding 37.22 acres, for surface mining, auger mining or highwall mining, which includes requesting a waiver to exceed the acreage limit from the original acres in the Pocahontas No. 9 Seam of coal. The proposed operation is discharging into Laurel Creek of Piney Creek of New River of Kanawha River and is located 2.0 miles west/northwest of Ghent in the Shady Spring District of Raleigh County.
