NOTICE OF TRUSTEE S SALE
Pursuant to a Deed of Trust dated December 18, 2017, executed by Brandon D. Frame, Grantor, conveyed unto Martha Haymaker and David G. Palmer, Trustees, on behalf of Calhoun County Bank, Inc., and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Lien Book 2001 at page 586, and pursuant to that certain Substitution of Trustee dated December 15, 2021, of record in the aforesaid Clerk s Office in Lien Book 2221 at page 728, the undersigned will sell at public auction on February 18, 2022, at 9:30 a.m. at the front door of the Wood County Courthouse in Parkersburg, West Virginia, all that certain lot, tract or parcel of land situate, lying and being in the District of Slate, County of Wood, and State of West Virginia, more particularly bounded as described as follows:
BEGINNING for reference at a point in the center of Slate Creek Road, State Secondary Road 19 at the center of the stone bridge where Cow Run crosses Slate Creek Road. THENCE N 69 55 12 W a distance of 139.38 feet to a pipe found, said pipe being the True Point of Beginning for the parcel herein described, THENCE S 56 04 48 W a distance of 153.99 feet to a 5/8 capped rebar set in the edge of Cow Run; THENCE N 82 55 12 W a distance of 165.00 feet to a 5/8 capped rebar set on the edge of Cow Run; THENCE S 82 07 27 W a distance of 594.00 feet to a point in the center of Cow Run Road, State Secondary Road 19/14; THENCE S 74 21 06 W a distance of 245.32 feet to a 5/8 capped rebar set on the south side of Cow Run Road; THENCE N 35 21 59 E a distance of 352.68 feet to a 7 White Oak at the northeast corner of Tract O conveyed unto Richard Davis, Deed Book 639-470 and the southeast corner of Tract N conveyed unto Richard Thomas, Deed Book 921-153; THENCE N 41 23 25 E a distance of 508.27 feet to a 5/8 capped rebar set at the northwest corner of Tract Q-1 conveyed unto Johnny R. Queen, Deed Book 1156-108 and the southwest corner of Tract Q-1A conveyed unto Charles F. Hughes, Jr., Deed Book 1107-151, where a 20 White Oak bears n 41 23 25 E a distance of 462.07 feet and a pipe found bears N 41 23 25 E a distance of 1405.30 feet; THENCE S 65 45 23 E a distance of 192.24 feet to a 5/8 capped rebar set; THENCE S 28 50 32 E a distance of 207.40 feet to a pipe found; THENCE S 84 55 32 E a distance of 267.00 feet to a 5/8 capped rebar set; THENCE S 11 25 24 E a distance of 175.00 feet, passing a 5/8 capped rebar set at 155.21 feet, to the point of Beginning, containing 8.0630 Acres, more particularly shown on the plat survey made by Charles F. Hughes, Jr., Professional Surveyor No. 872, dated August 27, 2010 of record and to be made a part hereof.
Subject to all legal highways, right of ways, easements, restrictions and reservations of record.
Bearings are based on an assumed meridian and are sued to denote horizontal angles only.
All rebar set are 5/8 X 30 with a plastic cap stamped HUGHES OH 7182, WV 872.
This legal description was prepared by Charles F. Hughes, Jr., Professional Surveyor 872, based on field surveys in August 2010.
Being the same property conveyed unto Brandon D. Frame from Johnny R. Queen by Deed dated December 5, 2017, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1271 at page 420.
TERMS OF SALE: Ten percent (10%) of the purchase price as a cash deposit at the time of the sale with the balance due and payable within thirty (30) days of the date of the sale. Sale is subject to all unpaid taxes and assessments, which shall be assumed by the Purchaser.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for the sale.
