UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
March 23, 2022
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by JEFFREY A. HAMMONDS and CATHERINE S. HAMMONDS, and DOYLE E. FINCHAM and MARY C. FINCHAM to David H. Wilmoth and David J. Orr, as Trustees, which deed of trust is dated the 28th day of October, 2004, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 388, at Page 1; and given to secure Mountain Valley Bank, the payment of a note therein described.
By Substitution of Trustee dated February 7, 2022, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 615, at Page 201, Jennifer L. Morgan was appointed Substitute Trustee.
The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction is that certain tract or parcel of real estate situate in Middle Fork District, Randolph County, West Virginia, lying southeast of WV Secondary Route 46 and on the waters of Arch McCauley Creek, designated as part of Lot “A”, more particularly bounded and described as follows:
“Beginning at a point in or near the center of Arch McCauley Creek; thence
S 44* 15′ 57″ W 80.80′ leaving said Arch McCauley Creek and traveling with a line, passing a 5/8″ rebar set at 11.33 ft., to a set 5/8″ rebar, said rebar bears N 33* 22′ 13″ E 130.15 ft. from a found double apple, said rebar also bears N 11* 03′ 09″ E 157.45 ft. from a found rebar with cap; thence
N 44* 38′ 51″ W 205.52′ traveling into the reserved lands of Fincham, DB 376/24, which this is a part of to a set 5/8″ rebar, said rebar bears N 13* 54′ 24″ E 187.59 ft. from a found double cherry, said rebar also bears S 57* 15′ 27″ E 253.77 ft. from a found 1/2″ rebar; thence
N 08* 52′ 53″ E 83.12′ traveling to a set 5/8″ rebar, said rebar bears S 36* 18′ 33″ E 170.94 ft. from a found 1/2″ rebar; thence
N 85* 48′ 51″ E 74.08′ traveling with a line, passing a 5/8″ rebar set at 56.23 ft., to a point in or near the center of Arch McCauley Creek; thence
S 09* 45′ 06″ E 26.68′ traveling with or near the center of Arch McCauley Creek, to a point; thence
S 41* 46′ 14″ E 59.22′ traveling with or near the center of Arch McCauley Creek, to a point; thence
S 38* 01′ 25″ E 60.83′ traveling with or near the center of Arch McCauley Creek, to a point; thence
S 29* 36′ 17″ E 66.14′ traveling with or near the center of Arch McCauley Creek, to the beginning.
Containing 0.54 acres, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, WV, in September 2004.
There is excepted and reserved from this conveyance a right of way across the instant real estate for the benefit of Doyle E. Fincham and Mary C. Fincham for access to their well, the Arch McCauley Road, or other property they own as contained in the that certain deed dated September 8, 2004, of record in Deed Book 498 at page 489.”
And being the same real estate conveyed to Catherine S. Hammonds by Doyle Fincham and Mary Fincham, by virtue of a deed dated September 8, 2004, and of record in the Office of the Clerk of the County Commission Randolph County, West Virginia, in Deed Book 498, at Page 489.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally on day of sale and any continuance thereof.
