ORDER AND NOTICE FOR AN ADDITIONAL LEVY TO THE VOTERS OF CLAY COUNTY
That at a regular meeting of the Clay County Commission of the County of Clay, State of West Virginia, held on the 14th day of February, 2022, as provided by law, the following order was made and entered of record, to wit:
The Clay County Commission, being of the opinion that the maximum levies for the current expenses authorized by Article 8, Chapter 11, of the Code of West Virginia, as amended, will not provide sufficient funds for the payment of current expenses of the Clay County Commission, including expenditures for the purpose or purposes hereinafter set forth, and that an election should be held to increase such levies under the provision of Section 16, Article 8, Chapter 11, as amended, it is hereby ordered:
1. That the purpose or purposes for which additional funds are needed is to provide payment of the
expenses of the Clay County Volunteer Fire Departments “Clay Volunteer Fire Department, Big
Otter Volunteer Fire Department and Lizemore Volunteers Fire Department,” and Clay County
Ambulance Service. Each agency will receive 1/4 of funds that are collected and if one of the
agencies closes, then the remaining funds will be divided equally between the remaining agencies.
Funds will provide:
a. Operational and maintenance support.
2. That the annual approximate amount for said purpose is $290,403.00 after estimated Tax discounts,
exonerations and delinquencies, annually for the term of the levy. Excess collections will be
distributed equally to the Clay Volunteer Fire Department, Big Otter Volunteer Fire Department,
Lizemore Volunteer Fire Department and Clay County Ambulance Service.
3. That the estimated separate and aggregate assessed valuation of Class of Taxable Property within the
County of Clay is as follows:
Class I $0
Class II $78,167,823
Class III $140,335,445
Class IV $10,653,281
Total $229,156,549
4. That the proposed additional rate of levy in cents per one hundred dollars assessed valuation on each
class of property is:
Clay County Volunteer Fire Departments “Clay
Volunteer Fire Department, Big Otter Volunteer
Fire Department and Lizemore Volunteer Fire
Department” and Clay County Ambulance Service
Class I 4.20 cents
Class II 8.40 cents
Class III 16.80 cents
Class IV 16.80 cents
5. That the proposed years to which the additional levy shall apply for the fiscal years beginning July 1,
2022; July 1, 2023; July 1, 2024; July 1, 2025 and July 1, 2026.
6. That the Clay County Commission will not issue bonds upon approval of the proposed levy.
7. That the question of such additional levy shall be submitted to a vote at an election to be held on the
10th day of May, 2022.
8. That a notice calling such election shall be given by the publication of this Order at least once each
week for two successive weeks next preceding said election in two newspaper of opposite politics
and of a general circulation in the territory in which the election is held. If there is only one newspaper
published in the county, said publication shall be made therein. All the provisions of the law
concerning General Election shall apply so far as they are practicable.
9. That the ballot to be used as such election shall be in form as follows:

Special election to authorize additional levies for the fiscal years beginning July 1, 2022; July 1, 2023; July 1, 2024; July 1, 2025 and July 1, 2026 for the purpose of providing operational and maintenance support for the Clay County Volunteer Fire Departments “Clay Volunteer Fire Department, Big Otter Volunteer Fire Department and Lizemore Volunteer Fire Department” and Clay County Ambulance Service in the approximate amount of $290,403.00 annually during the term of the levy; according the order of the Clay County Commission entered on the 14th day of February, 2022.
That the additional rate of levy in cents per $100 dollars of assessed valuation on each class of
property shall be:
Class I 4.20 cents
Class II 8.40 cents
Class III 16.80 cents
Class IV 16.80 cents
