Sealed proposals will be received by the City of Williamstown, at the Municipal Building, 100 West Fifth Street, Williamstown, West Virginia, until 1:30 p.m., local prevailing time, July 23, 2015, at which time all sealed BIDS received in complete order will be publicly opened and read aloud for:

 

WASTEWATER COLLECTION SYSTEM IMPROVEMENTS

 

Contract No. 1 ­ Construction of approximately 173 l.f. of 12-inch gravity sewerline, 935 l.f. of 8-inch gravity sewerline, 4 manholes, 200 l.f. of 2-inch waterline, and miscellaneous appurtenances.

 

The Contract Times associated with this Project consist of 120 days to achieve Substantial Completion and ready for final payment within 150 days, both time periods commencing from the date specified in the Notice to Proceed. Liquidated damages for delay as listed in the Bidding Documents are $800.00 per day applicable both to date of Substantial Completion and date of ready for final payment.

 

The City of Williamstown reserves the right to reject any or all Bids, including without limitation, nonconforming, non-responsive, unbalanced, or conditional Bids. OWNER further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to be non-responsible. OWNER may also reject the Bid of any Bidder if OWNER believes that it would not be in the best interest of the Project to make an award to that Bidder. OWNER also reserves the right to negotiate Contract terms with Successful Bidder.

 

SUSPENSION AND DEBARMENT

 

Recipient shall not entertain the use of businesses that are listed on the âExcluded Parties List Systemã at www.epls.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

 

WV ALCOHOL & DRUG FREE WORKPLACE ACT

 

West Virginia Code Œ 21-1D-5 provides that any solicitation for a public improvement construction contract requires each Vendor that submits a Bid for the Work to submit at the same time an affidavit of compliance with the Bid. The enclosed Drug-Free Workplace affidavit must be signed and submitted in the first envelope as evidence of the Vendor’s compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug-Free Workplace affidavit in the first envelope shall result in disqualification of such Bid.

 

NONSEGREGATED FACILITIES

 

Bidders on this work will be required to comply with the Presidents Order No. 11246, which prohibits discrimination in employment regarding race, creed, color, sex or national origin.

 

Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, and the Contract Work Hours Standards Act.

 

It is proposed to fund the construction of the herein described improvements utilizing Clean Water State Revolving Fund monies. P.L. 113-76, Consolidated Appropriations Act, 2014 (Act), includes an âAmerican Iron and Steel (AIS)ã requirement in Section 436 that requires Clean Water State AB-2

 

Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.

 

The Contractor must comply with the minimum rates for wages for laborers and mechanics as determined by the Secretary of Labor in accordance with the provisions of the Davis-Bacon and Related Acts. The Contractor will also be required to pay the prevailing hourly rate of wages as set forth in Œ21-5A-5 of the West Virginia Code.

 

A mandatory pre-bid meeting for this Contract is scheduled for 10:00 am on July 7, 2015 at the Municipal Building, 100 West Fifth Street, Williamstown, WV. All prospective Bidders shall attend this meeting in order for their Bid to be eligible for consideration as being responsive.

Copies of the Bidding Documents may be obtained from Boyles and Hildreth, Consulting Engineers by submitting a check or money order made payable to Boyles and Hildreth, Consulting Engineers, in the amount of $100.00 per contract, which is non-refundable. In addition, there will be a delivery charge of $25.00 if delivery is required. This delivery charge is not refundable and delivery is at the requester’s risk. In order to be considered a valid and responsible Bidder, the Bidder must obtain a copy of the Bidding Documents from the Engineer’s office prior to the Bid opening date.

 

The Bid opening procedure shall be a two envelope system. The system shall consist of two separate and distinct envelopes each with proper identification. The first envelope shall be identified as âBid Opening Requirementsã and the second as âBid Proposalã. Both shall be submitted in a single, large envelope, labeled with the contractor’s name, address, and name of the project with the contract number. The first envelope shall contain the items complete as shown in the checklist contained in the Instructions for Bidders section of the Project Manual. The second envelope (âBid Proposalã) shall consist solely of the Bid Form. In the event that all of the items are not complete on the checklist from the first envelope, the second envelope shall not be opened. The Bidder will be declared non-responsive.

 

A certified check payable to the City of Williamstown or a BID Bond executed by the Bidder and a Surety Company in conformance with the requirements of the Bidding Documents, in the amount equal to five percent (5{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the BID, shall be submitted with each BID, to guarantee the Bidderás entrance into a Contract, if given the award. No BID Bond shall be waived or returned because the Bidder failed to or cannot comply with any requirements as set forth in the Bidding Documents or any applicable statutes of the United States, the State of West Virginia and/or all local ordinances.AB-3

 

No BID may be withdrawn for a period of ninety (90) days after the time of the opening of the BIDS.

 

Any Contractor submitting a BID on this project hereby certifies, indicates, and acknowledges that he has a proper, current, valid license to perform the contemplated work and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed.

 

All Bidders must also include their Contractor’s license number on any BID(s) submitted. A Subcontractor shall furnish such person’s Contractor’s license number to the Contractor prior to the award of the Contract as referenced to in the West Virginia State Code Œ 21-11-11.

 

All Bidders shall understand that their BID will not be read, and rejected immediately, if proper BID surety does not accompany the BID or if the BID is found to be incomplete or non-responsive. This determination will be made by the Owner, or his agents or representatives, immediately after opening the sealed BID and prior to reading the BID. It shall be understood that it is the Bidder’s responsibility to provide a complete and valid BID and BID surety.
