MAIN STREET, SUITE 2000, LEXINGTON, KY 40507 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 722.39 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number S300795 to Coal Surface Mine in the Middle Kittanning, Lower Kittanning, Clarion, Stockton 'A', Stockton, Coalburg, Winifrede, Chilton, and all splits thereof seams of coal.
The operation is discharging into Sycamore Branch, Toms Branch and Unnamed Tributaries of Paint Creek, and Unnamed Tribuaties of Armstrong Creek all of Kanawha River and is located 2.5 miles, southwest of Powellton in Valley and Cabin Creek Districts of Fayette and Kanawha Counties, Longitude 81° 21' 38" and Latitude 38° 04' 02" (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until 8/22/2026 or thirty (30) days from date of final publication. A copy of the application will be available for review until 08/22/2026, or thirty (30) days from the date of final publication in the DEP Regional Office located at the address above and is available at
