Notice is hereby given that MABEN COAL LLC, 250 WEST MAIN STREET, SUITE 1900, LEXINGTON, KY 40507 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 316.55 acres in order to Surface and Highwall mine an additional 78.34 acres contiguous to the approved permit area, add area mining methods, and where part of the proposed permit area is within 100 feet of the right-of-way for US Route 121. in the Sewell and all associated splits thereof seam of coal.
The proposed operation is discharging into unnamed tributaries of Allen Creek, unnamed tributaries of/and Left Fork Allen Creek, Right Fork of Cedar Creek, unnamed tributaries of/and Cedar Creek, and unnamed tributaries of/and Slab Fork, of Guyandotte River and is located 5.3 miles, northeast of Mullens in Slab Fork District of Raleigh and Wyoming County, Longitude 81° 22' 10" Latitude 37° 38' 43" .
