Notice of Open Comment Period
On October 8, 2025, Rust and Sons Cremation Care, LLC has applied to the WV Department of Environmental Protection, Division of Air Quality (DAQ) for a Modification Permit for crematory located at 14 Clayton Lane, Oak Hill located in Fayette County, West Virginia at 37.9394 and -81.1537. A preliminary evaluation has determined that all State and Federal air quality requirements will be met by the modified facility. The DAQ is providing notice to the public of an open comment period for permit application R13-3600A.
The following changes in potential emissions will be authorized by this permit action: Total Particulate Matter, 0.230 TPY; Particulate Matter 10 microns or less, 0.110 TPY Sulfur Dioxide, 0.410 TPY; Oxides of Nitrogen, 0.493 TPY; Carbon Monoxide, 0.190 TPY; and Volatile Organic Compounds, 0.493 TPY.
Written comments or requests for a public meeting must be received by the DAQ before 5:00 p.m. on Thursday, December 4, 2025. A public meeting may be held if the Director of the DAQ determines that significant public interest has been expressed, in writing, or when the Director deems it appropriate.
The purpose of the DAQs permitting process is to make a preliminary determination if the proposed modification will meet all state and federal air quality requirements. The purpose of the public review process is to accept public comments on air quality issues relevant to this determination. Only written comments received at the address noted below within the specified time frame, or comments presented orally at a scheduled public meeting, will be considered prior to final action on the permit. All such comments will become part of the public record.
