NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated July 8, 2013, from Ronald Bailey and Betty Bailey to Sharon Borich and Lynn Mayberry, Trustees, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 1259, at page 413, securing a promissory note in the principal amount of $61,500.00 payable to New Peoples Bank, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by New Peoples Bank, Inc., the undersigned Successor Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on September 9, 2019 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all of those certain lots or parcels of real estate, together with the improvements thereon and appurtenances thereunto belonging, lying and being in Beaver Pond District, Mercer County, West Virginia, being Lot No. 37 and Lot No. 38, and being more particularly bounded and described as follows, to-wit:

BEGINNING at a point the southwest corner of Lot 39 in said Addition, which beginning point is located in the eastern line of Orchard Street; thence continuing along and with the eastern line of Orchard Street, N. 12deg. 10′ W. 52.815 feet to an iron pin as shown on said Map and in the eastern line of Orchard Street; thence along and with the eastern line of said street, N. 24deg. 12′ E. 200.67 feet to an iron pin; thence with a curve to the right chord N. 86-37 E. 35.46 feet and with the said street line as shown on said Map with its intersection with the western line of Circle Drive to an iron pin in the western line of Circle Drive; thence along and with the western line of Circle Drive, S. 30deg. 58′ E. 128.10 feet to an iron pin in the eastern line of Lot 38 and the western line of Circle Drive; thence continuing along said street the northwestern corner of Lot 39; thence along and with line S. 34deg. 54′ E. 20.35 feet to a point in said street line, the northern line of Lot 39, S. 59deg. 02′ W. 214.34 feet to the BEGINNING.

And being the same real estate conveyed to Ronald Bailey and Betty Bailey, husband and wife, from Coy Poff and Julie Gardner Poff, husband and wife, by Deed dated July 2, 2013, of record in the aforesaid Clerk’s office in Deed Book No. 993, at page 86.

Said property is conveyed subject to the following restrictions and covenants:

1. That no residence or other principal buildings shall be built on said property costing less than Sixty-Five Hundred Dollars ($6,500), but this covenant shall not apply to the out building, garage and accessory building used in connection with said property.

2. No building or part thereof including verandas and porches, shall be built nearer to the front of said lots than a building line of 25′ from the street upon which said lots face.

The aforementioned covenants shall run with the title of said land, with the right in any owner of real estate in said section or sub-division or enforce the same.

Terms of the sale: cash on date of sale.
