AN ORDER OF THE BOARD OF EDUCATION OF THE COUNTY OF CLAY DIRECTING AN ELECTION TO BE HELD TO AUTHORIZE ADDITIONAL TAX LEVIES FOR FISCAL YEARS BEGINNING JULY 1, 2023, JULY 1, 2024, JULY 1, 2025, JULY 1, 2026, AND JULY 1, 2027
BE IT ORDERED BY THE BOARD OF EDUCATION OF COUNTY OF CLAY:
The Board of Education of the County of Clay, finding that the maximum levies for current expenses authorized by Article 8, Chapter 11, of the West Virginia Code, as last amended, will not provide sufficient funds for the payment of the current expenses of the Board of Education of the County of Clay, including expenditures for the purposes hereinafter stated, and that an election should be held to approve levies as provided for under the provision of Section 16, Article 8, Chapter 11 of the West Virginia Code, as last amended, it is hereby ordered:
(1) That the purposes for which funds he needed are to maintain and improve the instructional programs
and the operation of school services in Clay County including, but not limited to:
A. School Safety and Building Maintenance – including innovative safety measures and
security upgrades to all school facilities to better ensure the safety of all students,
remodeling and construction, fix, maintain and upgrade building systems and
equipment such as roofs, heating and cooling, electrical, air quality, and other
building systems and equipment $ 159,471
B. Textbooks, School Supplies, & Equipment – including library books, workbooks,
pencils, paper, and other materials and equipment needed within the classroom and
student devices, including the repair and maintenance of classroom technology and
student devices $ 148,840
C. Utilities – including gas, water, electricity, garbage collection, and exterminating for
all facilities $ 127,578
D. Transportation and Extra-Curricular Activities – including curricular and extra-curricular
buses, county library, 4-H, performing arts, transporting students to job sites, and any
other PreK-12 school-sponsored activities and competitions $ 79,736
E. College Tuition – including tuition for Clay County High School students enrolled in
dual credit and dual enrollment coursework $ 15,948
(2) The approximate amount considered necessary for said purposes in said five (5) fiscal
years is the sum of $531,573 annually.
(3) The total amount necessary to carry out the above purposes is $ 2,657,865.
(4) That the separate and aggregate assessed valuation of each class of taxable property within
its jurisdiction is as follows:

(5) That the proposed maximum rate of levy in cents on each class of property per $100 valuation
within the Clay County School district shall remain as follows:
Class I 6.50 cents
Class II 13.00 cents
Class III 26.00 cents
Class IV 26.00 cents
(6) That the years to which the proposed continuation shall apply are the fiscal years beginning
July 1, 2023, July 1, 2024, July 1, 2025, July 1, 2026, and July 1, 2027.
(7) That no issuance of bonds is proposed in connection with this levy.
(8) That the Board of Education of the County of Clay is hereby authorized and empowered to expend,
during the term of this levy, the surplus, if any, accruing in excess of the amounts needed for any of the above stated purposes, plus excess collections due to increased assessed valuations to enrich,
supplement, and improve the educational services and/or facilities in the public schools of the County
of Clay. In the event that the amount collected is less than the amounts noted for the aforementioned
purposes, the Board of Education expenditures may be reduced in any particular category or
categories, as may be required.
(9) In the event the Board of Education of the County of Clay shall obtain additional money, by grant or
otherwise, from the state or federal government or from any agency of either, or from any other
source, for the purposes aforesaid, such additional money may be used either in substitution for, or in
addition to, the sums obtained from such additional levies as said Board of Education of the County
of Clay may from time to time determine.
(10) That should any item in the aforementioned purposes be unconstitutional or invalid due to judicial or
legislative action, affected funds will be distributed among remaining unaffected items.
(11) That the Board of Education of the County of Clay may, if the Board deems it to be in its best
interests, reduce these said rates in any given year or years during the term of this levy after
determining the sufficiency of funds for school purposes for the next ensuing taxable year.
(12) That the question of such tax levies shall be submitted to a vote at an election to be held on
November 8, 2022.
(13) That notice calling such election shall be given by the publication of this Order once each week for
two successive weeks before said election in the Clay County Free Press, a newspaper of general
circulation in the Clay County School District. All the provisions of the laws concerning general
elections shall apply as far as they are practicable, with the exception of the provisions contained in Section 17, Article 8, Chapter 11 of the West Virginia Code, as last amended.
(14) That the ballot to be used at such election shall be in form as follows:

A special election to authorize additional levies for the fiscal years beginning July 1, 2023, July 1, 2024, July 1, 2025, July 1, 2026, and July 1, 2027, according to an order approved by the Clay County Board of Education, State of West Virginia, on August 8, 2022, for the purposes and in the approximate annual amounts, as follows:
A. School Safety and Building Maintenance – including innovative safety measures and
security upgrades to all school facilities to better ensure the safety of all students,
remodeling and construction, fix, maintain and upgrade building systems and
equipment such as roofs, heating and cooling, electrical, air quality, and other building
systems and equipment $ 159,471
B. Textbooks, School Supplies, & Equipment – including library books, workbooks, pencils,
paper, and other materials and equipment needed within the classroom and student devices,
including the repair and maintenance of classroom technology and student devices $ 148,840
C. Utilities – including gas, water, electricity, garbage collection, and exterminating for
all facilities $ 127,578
D. Transportation and Extra-Curricular Activities – including curricular and extra-curricular
buses, county library, 4-H, performing arts, transporting students to job sites, and any
other PreK-12 school-sponsored activities and competitions $ 79,736
E. College Tuition – including tuition for Clay County High School students enrolled in

That the total approximate annual amount needed to be raised for said purposes, after allowances for discounts, delinquencies and exonerations, is $ 531,573.
That the proposed, continued additional rate of levy in cents per one hundred dollars of assessed valuation on each class of property is as follows:
Class I 6.50 cents
Class II 13.00 cents
Class III 26.00 cents
Class IV 26.00 cents
The Board of Education, however, reserves the right and authority to reduce the rates of the excess levy if increases in assessed valuations produce funds beyond the projected needs in any year specified in the levy call.
Should any additional monies be obtained by grant or otherwise from the state or federal government or any other source, the additional money may be used either in substitution or in addition to the amount obtained from this levy.
Should collections from the additional levies be in excess of the amounts projected, the Board of Education reserves the right to expend the surplus for any of the above stated purposes or to enrich, supplement, and improve the educational services and/or facilities in the public schools in the county. In the event that the amount collected is less than the amounts projected herein, the Board of Education reserves the right to make the reduction in any of the above stated purposes.
Instructions to voters: Those favoring renewal of the levy, mark the square entitled “FOR THE LEVY.” Those against the renewal of the levy, mark the square entitled “AGAINST THE LEVY.”
