ADVERTISEMENT FOR BIDS
Sealed Bids will be received by the Town of Davis at the Town Hall, located at 505 William Avenue, Davis, WV 26260, at the specified dates and times for the following work:
Town of Davis Water System Improvements:
Contract No .1: Distribution System Upgrades, until 1:00 P.M., L.P.T., May 21, 2020.
Contract No. 2: Water Treatment Plant Improvements, until 1:00 P.M., L.P.T., May 21, 2020.
The total base bid price for each contract shall include the costs for furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Information for Bidders, Forms of Proposal, General Conditions, Supplemental General Conditions, and Plans and Detail Specifications prepared by Chapman Technical Group. Immediately following the scheduled closing time for the reception of bids, all proposals that have been submitted in accordance with the conditions of this project will be publicly opened and read aloud.
The work to be bid upon is described as follows:
Contract No. 1
The Project consists of the installation of approximately 7,500 L.F. of 8” PVC C900 waterline; 25 L.F.
of 2” PVC waterline; 59 water meter assemblies; 2,650 L.F. of 3/4” copper service line; 6 fire hydrant
assemblies; 450 L.F. of Type “A” roadway restoration; 225 L.F. of concrete driveway restoration;
800 L.F. of Type “C” roadway restoration; 450 L.F. of asphalt driveway repair; 350 L.F. of rip-rap; and
connections to existing waterlines and is identified as Contract No. 1-Distribution System Upgrades and
is shown on Contract Documents prepared by Chapman Technical Group.
Construction time limit is 210 calendar days for Contract No. 1.
Contract No. 2
The project consists of the replacement of multimedia filter components including filter media,
underdrains, troughs, wash system, controls, and switchgear; the replacement of piping, valves, and
actuators in the pipe gallery, instrumentation for filters, and new water plant laboratory equipment,
and is identified as Contract No. 2-Water Treatment Plant Improvements and is shown on Contract
Documents prepared by Chapman Technical Group.
Construction time limit is 250 calendar days for Contract No. 2.

Each prospective Bidder is required to purchase a minimum of one copy of the Bidding Documents.
Failure of any Bidder to purchase plans, specifications, and contract documents from the Engineer prior to submittal of bid will result in the rejection of said bid. These documents consist of plans, specifications and a bid submittal packet. The bid submittal packet provides an unbound copy and listing of the items which are to be submitted with the Bid. Plans and Specifications MUST be obtained by each Bidder from the office of Chapman Technical Group, 200 Sixth Avenue, St. Albans, West Virginia 25177, telephone (304) 727-5501, upon payment of a $200 for each contract. Payment is not refundable. If Plans and Specifications are requested to be mailed by the Engineer, Bidders shall also pay $40.00 for the cost of shipping.
Each BID for each contract must be submitted in a separate sealed envelope containing the executed Form of Proposal, and included in a larger sealed envelope containing the Bid Bond, Power of Attorney, Certificate of Receipt of Addenda, Drug-Free Workplace Affidavit, WV Contractor’s License, Certification of Bidder Regarding Section 3 and Segregated Facilities, Certification of Bidder Regarding Equal Employment Opportunity, Section 3 Workforce Needs, Section 3 Project Businesses, and Section 3 Contractor’s Plan. Both sealed envelopes must have the following information in the lower left hand corner for the respective contract being bid:

The Contractor’s Qualification Statement from the two (2) lowest bidders for each contract must be submitted to Chapman Technical Group, 200 Sixth Avenue, St. Albans, West Virginia 25177, by 4:00 P.M., May 27, 2020.
All prospective Bidders are required to attend a mandatory Pre-Bid Conference to be held at the Davis Town Hall, located at 505 William Avenue, Davis, WV 26260 on May 14, 2020, at 1:00 P.M. for the purpose of discussing the project and touring the project site. Due to COVID-19 concerns, only one representative per bidder will be allowed to attend this meeting. Please note that this will be the only date for bidders to enter the water treatment plant prior to the bid. A teleconference will be set up for those not needing to attend in person and the call-in information will be provided by an addendum.
Prospective Bidders are advised that the contract awarded under this Advertisement for Bids is likely to be funded by a variety of federal, state, and local funds. Neither the United States nor the State of West Virginia nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting contract.
Bidders on this work will be required to comply with the President’s Executive Order 11246, HUD Section 109, which prohibits discrimination in employment regarding race, creed, color, sex or national origin, and have non-segregated facilities. The requirements for bidders and contractors under this order are explained in the specifications.
This CDBG-Small Cities Block Grant project is to be financed in part by a grant from the United States Department of Housing and Urban Development (HUD) and the West Virginia Development Office.
The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701 u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD- assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.
The parties of this contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement Section 3. Bidders’ attention is directed to the Section 3 “Clause” set forth in the contract documents. Prospective Bidders are hereby advised that it is their responsibility to adhere to all applicable Federal, State, and Local requirements and regulations including but not limited to, Equal Employment Opportunity, Segregated Facilities, Discrimination in Employment, Affirmative Action and Minority Business Participation, the Civil Rights Act of 1964, the Anti-Kickback Act, and the Contract Work Hours Standards Act.
DBE REQUIREMENTS
Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract
documents to achieve Disadvantaged (Minority-Owned/Women-Owned/Small) Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.
The Bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to DBE businesses. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 31.36(e). Failure to demonstrate positive efforts to do so may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
NONDISCRIMINATION IN EMPLOYMENT
Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.
Prospective Bidders are hereby advised that it is their responsibility to adhere to all applicable Federal, State, and Local requirements and regulations including but not limited to, Equal Employment Opportunity,
Segregated Facilities, Discrimination in Employment, Affirmative Action and Minority Business Participation, the Civil Rights Act of 1964, the Anti-Kickback Act, and the Contract Work Hours Standards Act.
Bids shall be accompanied by a bid bond or a certified check in an amount equal to five percent (5%) of the bid to ensure the execution of the contract for which the bid is made. In case the bid is not accepted, the check or bid bond will be returned to the bidder, but if the bid is accepted and the bidder shall refuse or neglect to enter into a contract with the Town of Davis within fifteen (15) days after the time he has been notified of the acceptance of his bid, the said check or bid bond shall be forfeited to the Town of Davis as liquidated damages for the failure to do so.
No Bidder may withdraw his Bid for a period of ninety (90) days after the time of the opening of the Bids.
All bidders are required to provide a valid WV Contractor’s License Number with their bid per Section §21-11-11 of the West Virginia Code. Any Contractor submitting a Bid on this project hereby certifies, indicates, and acknowledges that he has a valid and current WV Contractor’s license, has examined and acknowledges site and working conditions, and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed.
The Town of Davis reserves the right to reject any and all Bids.
