NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 25, 2017, executed by Borrower, Alicia N. Linzy, to Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford, LLC, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1344, at Page 304. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 124 Elkview St, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 15, 2019, of record in the Clerk’s Office in Book 1367, Page 182. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

22nd day of March, 2019
at 12:00 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and being more particularly described as follows:

A certain tract or parcel of land known as Lot 24 Elkview Subdivision as shown upon a Map entitled “PLAT SHOWING ELKVIEW SUBDIVISION – PHASE 2, BEAVER POND DISTRICT, MERCER COUNTY, GLENWOOD, WEST VA., SCALE 1″ = 40′, DATED JULY 17,1996, SHIELDS ENGINEERING CO., ROUTE 1, BOX 197, BLUEFIELD, WFST VIRGINIA, TELEPHONE 304-327-7936, REVISED LOTS 19, 21, 23, 24 AND 26 ON 8/27/97″ and more particularly bound and described as follows:
BEGINNING at a point in the southern line of a 30 feet wide street, said point being a common corner of Lot 22 and Lot 24; thence with the western line of Lot 22 S 30deg. 21′ 50″ W. 100.52 feet to a 1/2 inch rebar in the northern line of Lot 23; thence with the northern line of Lot 23 N. 56deg. 26′ 45″ W, 114.22 feet to a 1/2 inch rebar set in the eastern line of a 40 feet wide street; thence with the eastern line of said 40 feet wide street on a curve to the right having a radius of 100.00 feet 55.13 feet on a chord bearing and distance of N 30deg. 30′ 20″ E, 54.44 feet to the P.C. of a curve to the right having a radius of 25.00 feet; and distance N.86deg. 32′ 00″ E, 32.295 feet to a point in the southern line of the aforementioned 30 feet wide street; thence with the southern line of said 30 feet wide street, S 53deg. 14′ 00” E, 78.85 feet to the point of BEGINNING, and containing 0.264 acres as shown on a plat of record.
And being the same property conveyed to Alizia N. Linzy by deed of Verna D. Blankenship dated October 24, 2017, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia simultaneously herewith.
This property is subject to a set of restrictive covenants and conditions which are of record in Deed Book 738 at page 194.
There is reserved from this conveyance an easement for driveway purposes for and on behalf of Lot #22, said easement for driveway purposes being shown upon the above said referred to map which said easement commences in the easternmost corner of Lot #24 and extends back in a westerly direction, approximately 29 feet, then runs parallel with the common line between Lots #22 and 24 in a general southeastern direction to a point where it intersects with the common dividing line between Lots #22 and 24. It is specifically understood that the actual description of said easement is as shown on the above referred to map.

Being the same property conveyed to Alicia N. Linzy by the Deed dated October 23, 2017 and recorded in Deed Book 1059 at Page 126 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
