NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 21, 2007, executed by Borrowers, Dana L Graham and David L Graham, to Tommy J. Dixon, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1111, at Page 207. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 276 Clines Country Road, Lashmeet, WV 24733. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 7, 2019, of record in the Clerk’s Office in Book 1373, Page 501. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

all of that certain tract or parcel of real estate located near Pinoak in Rock District, Mercer County, West Virginia, as shown on “PLAT OF SURVEY SHOWING A LOT DIVIDED PROM THE HARLESS & SHIRLEY MARTIN TRACT AS DESCRIBED IN DEED BOOK 388 AT PAGE 156 WHICH IS SITUATE NEAR PINOAK IN ROCK DISTRICT, MERCER COUNTY, WEST VIRGINIA Date: 07/2/92 Scale: 1″ = 50′ Dana Pettrey, Land Surveyor P. O. Box 641 Athens, W.V. 24712 (304) 384-7040 /s/ Dana Pettrey”, which said plat is intended to be recorded simultaneously herewith and made a part of this deed, and being more fully bounded and described as follows:
BEGINNING at a twin 48 inch white oak on a knoll on the north side of Secondary Route 6 which marks a common corner of Harless Martin and James Pacitto; thence N. 14deg. 48′ E. 127.40 feet with the common line of Harless Martin and James Pacitto to an iron pin set at a fence; thence S. 58deg. 22′ E. 62.67 feet running through the Harless Martin tract to an iron pin set; thence S. 35deg. 04′ E. 204.28 feet continuing through the Harless Martin tract to an iron pin found at the north corner of the Verna Mack parcel; thence S. 46deg. 47′ W. 85.1 feet with the northwest line of the Verna Mack parcel to an iron pin set in the north line of Secondary Route 6; thence N. 46deg. 15′ W. 195.52 feet with the north line of Secondary Route 6 to the BEGINNING, and containing 0.565 acre, more or less.

Being the same property conveyed to Dana L Graham and David L Graham by the Deed dated July 8, 1992 and recorded in Deed Book 724 at Page 67 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
