NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated January 8, 2018, from Randy Jones Jr. aka Randy Dale Jones, Jr. and Stacey N. Jones aka Stacey Nicole Adkins to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 1350, at page 229, securing a promissory note in the principal amount of $130,683.57, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on July 22, 2019 at 9:30 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain one acre parcel of land, together with improvements thereon and appurtenances thereunto belonging, located about one (1) mile Southwest of Gardner on the head waters of Rocky Branch of Black Lick Creek, Rock District, Mercer County, West Virginia, as shown on a survey by Olen Winfree, unrecorded, and more particularly bounded and described as follows:

BEGINNING at a steel rod set in the southern intersection of the right of ways of Secondary Route 7/2, called the Rocky Branch Road, and an abandoned old County Road, said steel rod being 15′ southeast from the apparent centerline of the said Rocky Branch Road and about .6 of a mile from Secondary Route 7 called the Gardner-Spanishburg Road, thence with the southwestern side of the said abandoned old County Road four calls: S. 49 deg. 12′ E. 86.20 feet to a steel rod set; thence S. 61 deg. 41′ E. 84.40 feet to a steel rod set, being the eastern corner of the Hokpins’ School lot; thence S. 67 deg. 21′ E. 110.00 feet to a steel rod set; thence leaving said abandoned old County Road and through Charles R. King’s 24.64 acre tract as recorded in Deed Book 527 at page 692 three calls: S. 34″ W. 13′ W. 113.16 feet to a steel rod set; thence N. 68″ 08′ W. 124.54 feet to a steel rod set; thence N. 55″ 22′ W. 293.55 feet to a steel rod set in the southeastern right of way of the said Rocky Branch Road, thence with the southeastern right of way of said road two calls: N. 58″ 58′ E. 45.00 feet to a steel rod set; thence N. 44″ 43′ E. 70.00 feet to the point of BEGINNING, containing one acre, more or less.

Being the same property conveyed from Matthew C. Tyree and Barbara A. Ratliff to Randy Jones, Jr. and Stacey N. Jones, husband and wife, by Deed dated October 10, 2017, of record in the aforesaid Clerk’s office in Deed Book No. 1059, at page 684.

Terms of the sale: Ten percent non-refundable cash deposit due at sale. Ninety percent balance of purchase price due within thirty days of date of sale.
