The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 30, 2023, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 202300009560, in Book No. 1325, at Page 809, Felicia Dawn Martin did convey unto Robert Skeens, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 20 – Worthington Lincoln District, Marion County, West Virginia, and more particularly described as follows:

All those five (5) contiguous and adjoining lots or parcels of land, together with all the improvements thereon and all the appurtenances thereunto belonging, situate in the incorporated Town of Worthington, Lincoln District, Marion County, West Virginia, and being more particularly bounded and described as follows:
PARCEL ONE: All of Lot Number 31 in what is sometimes called the “New Addition” to said Town of Worthington, which said lot is bounded and described in the hereinafter mentioned old Deed dated November 25, 1912 as follows:
Beginning at a stake on a proposed street and running thence N. 16º W. with said proposed street 100 feet to a stake; thence S. 71 1/4º W. 50 feet to a stake; thence S. 17 1/2º E. 100 feet to said proposed street, and thence with said street N. 71 1/4º E. 50 feet to the place of beginning, containing 5,000 square feet, more or less.
PARCEL TWO: An adjoining parcel of land, beginning at a post in line of schoolhouse lot and running thence with a line of said lot and a lot owned by C. E. Parish, S. 12 1/2º E. 187 1/2 feet to a stake, a corner to said Parish; thence S. 71 1/2º W. 138 feet to a stake; thence N. 9 1/2º E. 220 fee to a stake; and thence N. 86º E. 67 1/2 feet to the place of beginning, containing 0.49 of an acre, more or less.
PARCEL THREE: A parcel of land beginning at a corner of D. O. Robinson’s Lot No. 31 on Main Street (also U.S. Route No. 19) and running thence with said Main Street a distance of 20 feet to a corner of C. E. Parish; thence with line of said Parish in a Northerly direction 100 feet to another corner of said Parish and line of D. O. Robinson’s 0.49 acre parcel; thence with said line of D. O. Robinson’s 0.49 acre parcel. 20 feet to corner of said Robinson’s Lot No. 31; and thence with the same 100 feet to the place of beginning, containing 2,000 square feet, more or less.
PARCEL FOUR: All of Lot No. 30 in said “New Addition” to said Town of Worthington, beginning at a stake in the Southwest corner of said lot and running thence N. 18 3/4º W. 100 feet to a stake; thence N. 71 1/4º E. 50 feet to a stake; thence S. 18 3/4º E. 100 feet to a stake on street (U.S. Route No. 19); thence with said street, S. 71 1/4º W. 50 feet to the place of beginning, containing 5,000 square feet, more or less, which said Lot No. 30 adjoining said Lot No. 31 hereinabove described.
PARCEL FIVE: A small rectangular parcel of land on the rear of said Lot No. 30 hereinabove described, beginning at a stake in the Northwest corner of said D. O. Robinson’s Lot No. 30, and running thence N. 18 3/4º W. 22 feet to a stake in line of William Heskitt property; thence with line of said Heskitt, N. 71 1/4º E. 50 feet to a stake; thence S. 18 3/4º E. 22 feet to a stake, a corner to said Lot No. 30; and thence with line of said Lot No. 30, S. 71 1/4º W. 50 feet to the place of beginning, containing 1,100 square feet, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 211 Main St, Worthington, WV 26591.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.

PETITION FOR FORFEITURE

The object of this suit is to seek an Order forfeiting the herein described property pursuant to the West Virginia Contraband Forfeiture Act (Chapter 60A, Article 7, of the West Virginia Code, as amended).
TO: Any Claimant of a right or interest in said property
You have the right to file a claim to the herein described property on or before thirty (30) days of the date of this publication. Any such claim must clearly state the identity of the Claimant and an address where legal process can be served upon said claimant.
The property seized and subject of this suit is described as follows: $5,330.00 in U.S. CURRENCY
The law enforcement Agency responsible for the seizure is the Beckley/Raleigh County Drug and Violent Crime Unit.
The seizure took place on May 29, 2024, in Raleigh County, West Virginia. The property described above was found in the possession of Jaelan A. Morales.
That after the date for filing of said claim(s) an Order of the Court directing forfeiture of the seized property to the State and vesting ownership of said property shall be sought.
If you fail to file a claim, thereafter an Order, upon proper hearing, may be entered against you for the relief demanded in the Petition.
