NOTICE OF PUBLIC HEARING, TOWN OF SOPHIA, WEST VIRGINIA

NOTICE OF ANNEXATION PURSUANT TO WEST VIRGINIA CODE §8-6-4

Notice is hereby given by the Town of Sophia, West Virginia that it will hold a hearing for public input with regard to a Petition for Annexation pursuant to West Virginia Code §8-6-4 tendered by Raleigh County Board of Education the sole property owners (fee holders) and qualified voters within this territory which they have petitioned the Town of Sophia to annex.

The area of land proposed to be annexed consists of two (2) tracts approximately 15 acres owned by Raleigh County Board of Education and being described as:

TRACT ONE:

Beginning at a 5/8” rebar (set), along the northern line of the noncontrolled access right of way of West Virginia County Route 12/10, being the West Virginia Department of Transportation Division of Highway State project X-341-121-82.00 00. (DB 5006-PG 249). And being a new corner within Tract No. 14 of the Beaver Coal Company, LTD. (DB 5037 – PG 5289) tract. Said corner being referenced N 63° 05’ 50” E 2149.20’ to a set stone (found), called for, a corner to said Tract No. 14. Thence with the common line of said tract No. 14 and the said noncontrolled access right of way five (5) course and distances; S 59° 23’ 41” W 120.73’ to a ¾” rebar w/doh cap (found), thence; S 74° 54’ 49” W 162.85’ to a ¾” rebar w/doh cap (found), thence; S 04° 32’ 49” E 55.42’ to a ¾” rebar w/doh cap (found), thence; S 69° 47’ 40” E 162.79’ to a ¾” rebar w/doh cap (found), thence; S 33° 33’ 31” E 87.36’ to a ¾” rebar w/doh cap (found), thence leaving the said noncontrolled access right of way, and with five (5) new lines through said tract No. 14; S 69° 45’ 00” W 1205.64’ to a 5/8” rebar w/cap (set), a new corner, thence; N 24° 46’ 02” W 403.60’ to a 5/8” rebar w/cap (set), a new corner, thence; N 61° 18’ 12” E 1325.05’ to a 5/8” rebar w/cap (set), a new corner, thence; S 32° 30’ 55” E 238.70’ to a 5/8” rebar w/cap (set), a new corner, thence; S 34° 13’ 02” E 116.12’ to the point of beginning, containing 14.445 acres, more or less, as surveyed by ESI Services, Inc., Beckley West Virginia and more particularly shown on a plat entitled “PLAT OF PARTITION SURVEY PREPARED FOR BEAVER COAL COMPANY, LTD AND THE RALEIGH COUNTY BOARD OF EDUACTION SHOWING A TRACT OF LAND CONTAINING 14.445 ACRES OF LAND LOCATED ALONG WV COUNTY ROUTE 12/10” as recorded in the office of the County Clerk of Raleigh County, West Virginia in Map Book 5057 at page 1744.

EXCEPTING AND RESERVING unto the said Beaver Coal Company, Limited, its lessees and assigns, according to their respective estates and interests therein, and from and out of the operation of this deed, all the coal, oil, gas and other minerals in and underlying the surface of the said tract or parcel of land, with the right to mine, extract, remove and take away the entire amount and body of the said coal, oil, gas and other mineral in and underlying the same and other lands, without being in any way liable for any damages heretofore or hereafter done to the said tract or parcel of land, or to the surface thereof, or to any waters or water courses therein or thereon, or to any building or buildings, either public or private, erected thereon, or to any street, road or other way, either public or private, or to any public or private sewers, drains, drainage pipes, gas or water pipes or mains, or
electrical wires or lines of any kind, laid out, opened, dedicated, constructed, erected or used upon, over, through or under the same, by reason of the mining and removing of the said coal, oil, gas and other minerals; IT BEING EXPRESSLY UNDERSTOOD AND AGREED, and made a condition hereof, that neither the said party of the second part, its grantees, lessees, heirs or assigns, nor any other person or persons, corporation or corporations, in the event of damage heretofore or hereafter done to the surface of the said tract or parcel of land, or to any waters or water courses therein or thereon, or to any building or building either public or private, erected thereon, or to any street, road or other way, either public or private, or to any public or private sewer, drain, drainage pipes, gas or water pipes or mains, or electrical wires or lines of any kind whatsoever, laid out, opened, dedicated, constructed, erected or used upon, over, through or under the same, occasioned by the removal of the said coal, oil, gas and other minerals in and underlying the surface of the said tract or parcel of land, or other lands, shall have any claim or right of recovery against the party of the first part or its successors, lessees, grantees or assigns.

TRACT TWO:

A TRACT OF LAND LOCATED ALONG WV COUNTY ROUTE 12/10, ABOVE THE WATERS OF CRAB ORCHARD CREEK, TOWN DISTRICT, RALEIGH COUNTY, WV, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A ¾” REBAR AND CAP FOUND 58’ LEFT OF WV CO. RTE. 12/10 CENTERLINE STATION 10+66; THENCE N 69° 47’ 40” W 162.79’ TO A ¾” REBAR AND CAP FOUND 12’ RIGHT OF WATER TANK ROAD EXTENSION WEST (W) CENTERLINE STATION 0+40; THENCE N 04° 32’ 49” W 55.42’ TO A ¾” REBAR AND CAP FOUND 34’ LEFT OF EXTENSION WEST CENTERLINE STATION 0+40; THENCE N 74° 54’ 49” E 162.85’ TO A ¾” REBAR AND CAP FOUND 64’ LEFT OF WV CO. RTE 12/10 CENTERLINE STATION 2+00; THENCE S 0° 01’ 11” W 153.85’ TO THE PLACE OF BEGINNING, CONTAINING 16,189.51 SQUARE FEET, MORE OR LESS, AS SHOWN ON A SURVEY PREPARED BY ROBERT F. THAW, LICENSED PROFESSIONAL SURVEYOR, DATED MARCH 19, 2018, AND ATTACHED HERETO AS EXHIBIT A.

The tract of land hereinabove described is a portion of that same real estate conveyed to the West Virginia Department of Transportation, Division of Highways, from Beaver Coal Company LTD. by Deed dated October 26, 2000, of record in the Office of the Clerk of the County Commission of Raleigh County in Deed Book 5003, at Page 5011.

The Petition for annexation submitted by the Raleigh County Board of Education has been available for public inspection in the Mayor’s Office, Sophia Town Hall, Sophia, West Virginia since June 7, 2024. All interested citizens are invited to attend the public hearing scheduled for August 22, 2024, at 4:00 p.m. at Town Hall.
