TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 25, 2022, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50755809, in Book No. 5075, at Page 5809, and modified by Corrective Affidavit in Document No. 50830188, in Book 5083, at Page 0188, Austin Narvel did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC, FKA Quicken Loans, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 01 – Beckley District, Raleigh County, West Virginia, and more particularly described as follows:

BEGINNING at a point set, a 3/8 inch diameter steel reinforcing rod, being a corner to Lot 300 and being on the easterly edge of a 40 foot wide right of way; thence leaving said Lot 300 and with said right of way being a curve to the left having a radius of 76 feet, a delta angle of 17º 50’, the length of said curve being 23.66 feet to a point on a cul-de-sac; thence with said cul-de-sac being a curve to the left having a radius of 40 feet, a delta angle of 95º 42’, the length of said curve being 66.81 feet to a point set, a 3/8 inch diameter steel reinforcing rod; thence leaving said cul-de-sac and through the survey N. 3º 46’ E., 130.00 feet to a point set, a 4 inch diameter concrete marker and being a corner to Lot 302; thence with said Lot 302, S. 80º 21’ E., 142.63 feet to a point set, a 4 inch diameter concrete marker; thence S. 58º 01 ‘ E. 92.80 feet to a point set, a 3/8 inch diameter steel reinforcing rod; thence S. 73º 34’ E approximately 263.44 feet to a point on outside line; thence with said line S. 28º 40’ W., approximately 118 feet to a point; thence leaving said outside line N. 84º 25 ‘ W., approximately 171.47 feet to a point set, a 3/8 inch diameter steel reinforcing rod, being a corner to said Lot 300; thence with said Lot 300, N. 84º 25’ W., 239.50 feet to the place of beginning, and containing 1.70 acres, more or less, and being more particularly described on that certain map entitled “Map Showing Lot No. 301 in Woodcrest Addition, Being Part of Stanford Acres, Inc., Deed Book 557, Page 574 & Deed Book 585, Page 674, City of Beckley, Raleigh County, W. Va., 1.70 Acres, Surveyed by Jeffery J. Chambers L.L.S., Route 86, Box 5A, Jumping Branch, W. Va. 25969, Scale: 1” = 100’. Date 10-14-87, Job: 117F”, a copy of which said map is recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia with a deed from Stanaford Acres, Inc. to Rodney Jess Jarrett and Linda B. Jarrett dated February 25, 1988 and recorded in the Raleigh County Clerk’s Office in Deed Book 731 at Page 713.
Being the same property conveyed unto Austin Narvel by Deed of Cynthia M. Bickey and the Daniel Bickey Irrevocable Trust, also known as Daniel Bickey Revocable Trust, also known as Daniel Bickey Family Trust, by Cynthia M. Bickey Trustee and Matthew Daniel Morrison Bickey, Trustee dated 25 day of Jan 2022 to be recorded simultaneously with this document.
This deed is made and accepted subject to all valid and continuing, reservations, restrictions, conditions, and covenants made and contained in all prior deeds in the chain of title of the property herein conveyed. Further subject to protective covenants and reservations pertaining lots in Woodcrest Addition in the City of Beckley, Raleigh County, West Virginia, as shown and designated upon Map 3 thereof and of record in the said County Clerk’s office in Deed Book 586 at Page 324.
In addition to the restrictive covenants referred to above, the parcel or real estate conveyed herein shall be further subject to the following restrictions:
1. Only one (1) residence shall be constructed on the parcel herein conveyed;
2. In a ranch style dwelling is constructed on the parcel herein is shall have a minimum living area, exclusive of garage, of 1,800 square feet, and shall be constructed at a minimum cost of $90,000.00; and if a two (2) story dwelling is constructed on the parcel herein conveyed it shall have a minimum living areas, exclusive of garage, of 2,200 square feet, and shall be constructed at a minimum cost of $90,000.00 and
3. No portion of any residence constructed on the lot herein conveyed shall be built closer that forty feet (40) from the front lot line of the lot herein conveyed.
To have and to hold the real estate as herein above described, together with all of the improvement, rights, privileges, easements and appurtenances thereunto belonging or in anywise appertaining, unto the grantees and their assigns, forever.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 40 Chickadee Way, Beckley, WV 25801.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
