NOTICE OF PUBLIC HEARING
ON SEWER BOND ORDINANCE
A public hearing will be held on the following entitled Ordinance at a regular meeting of the Council of the City of Oak Hill to be held on Monday, September 9, 2024, at 6:00 p.m., in the Council Chambers at the Oak Hill City Hall, 100 Kelly Avenue, Oak Hill, West Virginia, and at such hearing any person interested may appear before the Council and present protests, all objections and suggestions shall be heard by the Council and it shall then take such actions as it shall deem proper in the premises upon an Ordinance entitled:
ORDINANCE AUTHORIZING THE ACQUISITION AND CONSTRUCTION OF CERTAIN ADDITIONS, BETTERMENTS AND IMPROVEMENTS TO THE EXISTING PUBLIC SEWERAGE FACILITIES OF THE CITY OF OAK HILL AND THE FINANCING OF THE COST, NOT OTHERWISE PROVIDED, THEREOF THROUGH THE ISSUANCE BY THE CITY OF OAK HILL OF NOT MORE THAN FOUR MILLION NINE HUNDRED FORTY-NINE THOUSAND DOLLARS ($4,949,000.00) IN AGGREGATE PRINCIPAL AMOUNT OF CITY OF OAK HILL SEWER REVENUE BONDS IN TWO SERIES, THE FIRST SERIES TO BE DESIGNATED “SEWER REVENUE BONDS, SERIES 2024 A (WEST VIRGINIA SRF PROGRAM)” AND THE SECOND TO BE DESIGNATED “SEWER REVENUE BONDS, SERIES 2024 B (WEST VIRGINIA SRF PROGRAM)”; PROVIDING FOR THE RIGHTS AND REMEDIES OF AND SECURITY FOR THE HOLDERS OF SUCH BONDS; AUTHORIZING EXECUTION AND DELIVERY OF ALL DOCUMENTS RELATING TO THE ISSUANCE OF SUCH BONDS; APPROVING, RATIFYING AND CONFIRMING BOND PURCHASE AGREEMENTS WITH THE WEST VIRGINIA WATER DEVELOPMENT AUTHORITY AND THE WEST VIRGINIA DEPARTMENT OF ENVIRONMENTAL PROTECTION RELATING TO SUCH SERIES 2024 A BONDS AND SERIES 2024 B BONDS; AUTHORIZING THE SALE AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH BONDS; AND ADOPTING OTHER PROVISIONS RELATING THERETO.
The above-entitled Ordinance was enacted by the Council of the City of Oak Hill upon petition of the Sanitary Board of the City of Oak Hill on August 12, 2024.
The above quoted title of the Ordinance describes generally the contents thereof and the purposes of the Bond issue contemplated thereby. The City of Oak Hill contemplates the issuance of the Bonds described in said Ordinance. The proceeds of the Bonds will be used to provide permanent financing of a portion of the costs of acquisition and construction of certain additions, betterments and improvements to the sewerage system for the City of Oak Hill. The Bonds are payable solely from revenues derived from the ownership and operation of the sewerage system of the City of Oak Hill. No taxes may at any time be levied for the payment of the Bonds or the interest thereon.
A certified copy of the above-entitled Ordinance is on file at the office of the Acting City Clerk of the City of Oak Hill in the Oak Hill City Hall, 100 Kelly Avenue, Oak Hill, West Virginia for review by interested parties during regular office hours.
Following the said public hearing, the Council intends to enact said Ordinance on final reading and to put said Ordinance into effect.
