NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated April 26, 2002, executed by Borrower(s), James E Sloan and Susan C. Sloan, to Joseph C. Hereford, Philip B. Hereforrd and David L. Watson, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5007, at Page 523, re-recorded in Book 5008, at Page 2303, and further re-recorded in Book 5009, at Page 1680. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 118 Wallace Ct, Beckley, WV 25801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 23, 2024, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

That certain lot or parcel of surface land situate on the waters of Miller Camp Branch, in First District or Trap Hill Tax District, Raleigh County, West Virginia, and which said tract of parcel of land is more particularly bounded and described as follows, to-·wit: BEGINNING at a hub corner on Clay Street of the Eccles Truck Farms, said hub being a common corner to Lots 45 and 46; thence with the northeastern right of way of Clay Street N 21 deg. 37` E, 170.0 feet to a hub corner; thence N. 48 deg. 43` E, 20 feet to a hub corner a common corner to Lots 46 and 47; thence through Lot No, 46 S. 43 deg. 52` E 257.30 feet to a hub corner, on the division line of Eccles Truck Farms and Mountain Farm Lots; thence through Lot No. 7 of the Mountain Farm Lots S. 66 deg. 15` E. 37.80 feet to a hub corner; thence S. 23 deg. 45` W. 50.00 feet to a hub corner, on the division line of Lots No. 7 and 9 of the Mountain Farm Lots; thence with the division line N. 66 deg. 15` W. 37.80 feet to a hub corner; on Lot No, 46 of the Eccles Truck Farms; thence S. 23 deg. 45` W, 40 feet to a hub, a common corner to Lots 4 and 46; thence with the division line N. 66 deg. 15` W. 240.0 feet to the beginning, containing 0.82 sere, more or less, and designated as Lot B on that certain map entitled MAP SHOWING LOTS A, B & C-FORMERLY LOTS 46 & 47 OF ECCLES TRUCK FARMS AND PORTION OF LOT NUMBER 7, OF MOUNTAIN FARM LOTS. BOBLETT–SURVEYOR–NO. 205,” which map is attached to a made a part of a deed to Robert H, Creamer, et ux, dated March 27, 1973, and to which reference is here made for a more particular description of the property herein conveyed.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
