TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in her by that Deed of Trust, dated February 21, 2019, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Book No. 1010 at Page 39, and Een Woodson did convey unto James Blankenship, Trustee certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elizabeth K. Campbell, as the Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by Kimberly Taylor to foreclose there under, will offer for sale at public auction at the front of the Fayette County Courthouse in Fayetteville, West Virginia, on September 20, 2024, at the hour of 9:30 am, the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, beginning at an iron pin on the south side of State Route 19/3 at the intersection of Second Avenue: thence, leaving said Avenue and with the south side of Route 19/3, S 87-57 E 265.47 feet to an iron pin; thence, N 69-04 E 79.94 feet to an iron pin, corner to Herbert E. Jones; thence, leaving said Route 19/3 and with Hones S 14 E 78.49 feet to an iron pin; thence continuing with said Jones S 72-50 W 323.67 feet to an angle iron and fence post at the intersection of Second Avenue and a 14-foot alley; thence, leaving said alley with the eastern side of Second Avenue N 18-05 W 159 feet to the point of beginning, and containing 0.81 of an acre, comprising the area of Parcel One, Two and Three, and being shown more fully on a map of plat thereof, entitled, “Plat Showing Parcels of Real Estate Owned by Joline Molinas and Milton Molinas, Situate Near Scarbro, Plateau District, Fayette County, West Virginia, Scale One Inc.= 60 Feet, November 1976, containing 0.81 acre, by Benbob, Inc.”. Reference to said map is here made for a more particular and accurate description of the property being conveyed herein. And being the same lots or parcels of real estate which was conveyed unto Kimberly Taylor, by Deed of David A. Cullum, dated August 17, 2012 and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 684 at Page 107. There is excepted and reserved from the above-described real estate property that certain on-controlled access right-of-way conveyed to West Virginia Department of Highways, a corporation, by deed dated August 3, 1976, of Joline Molinas and Milton Molinas, her husband of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 349 at Page 535. This Deed of Trust is made and accepted subject to all prior reservations, restrictions, covenants, and conditions granted or reserved by all predecessors in title, except those pertaining to race, color or creed. At the time of the execution of the Deed of Trust, this property was reported to have an address of 7798 Okey Patteson Road, Scarbro, West Virginia. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers of the sale shall be responsible for paying the recording costs and also tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
