PUBLIC HEARING
ON PROPOSED ORDINANCE

TO: CITIZENS OF THE CITY OF FAIRMONT:

The Council of the City of Fairmont at its regular meeting held September 10, 2024 introduced and publicly read in its entirety for the first time the following City Ordinances:

1. An Ordinance To Approve And Adopt Current Replacement Pages To The Fairmont City Code.

Copies of the proposed Ordinances are available in the office of the Interim City Clerk, Room 312, 200 Jackson Street, Fairmont, West Virginia.

The Public Hearing on the proposed items will be held at 7:00 p.m. or as soon thereafter as the matter may be heard on Tuesday, September 24, 2024 in Council Chambers, at the Public Safety Building, 500 Quincy Street, Fairmont, West Virginia.

Any interested person may appear at the public hearing and be heard as to whether or not said proposed Ordinance shall be enacted. All objections and suggestions shall be heard and Council shall take such action as it deems necessary in the premises.

To Whom It May Concern:

The purpose of this action concerns the legal guardianship of child respondent, F.P. The West Virginia Department of Human Services is seeking to locate Elizabeth Bryson and James Proskin. Elizabeth Bryson is the biological mother of F.P., who was born on October 27, 2017.
Counsel for the Department of Human Services is William C. Burdick, Assistant Prosecuting Attorney, 108 East Maple Avenue, Fayetteville, West Virginia, 25840.
It appearing that the whereabouts of Elizabeth Bryson and James Proskin are presently unknown at this time, it is Ordered that Elizabeth Bryson and James Proskin obtain from the Fayette County Circuit Clerk at the Fayette County Courthouse, Fayetteville, West Virginia, the Petition filed in this matter. Elizabeth Bryson and James Proskin must appear and defend on or before Friday, January 10, 2024, at 9:00 a.m., located in the Courtroom of the Honorable Thomas H. Ewing, Fayette County Courthouse Judicial Annex, Fayetteville, West Virginia, at which time a hearing will be held. Failure to answer and defend could result in a default judgment, and loss of custodial and visitation rights to the child.

Invitation to Bid

Sealed bids will be received by the McDowell County Commission of Welch, West Virginia for supplying
and installing playground equipment and related work at the Premier Playground located at 10
Mohaffey Road Welch, WV 24801. Bids will be received until noon on September 13, 2024 in the
County Clerk’s Office at 90 Wyoming Street, Suite 109 Welch, WV 24801.

Bids received after this date will not be considered.

Bids will be publicly opened and read aloud on September 16, 2024 at 2 pm during a special County
Commission Meeting, held at the Armory at 600 Stewart Street, Welch, WV 24801. Bidders are invited
to attend the meeting, but it is not a requirement. If the meeting is cancelled for any reason the bids
will be opened at the next regular meeting or special meeting.

Bid packets can be obtained at the McDowell Armory located at 600 Stewart Street Welch, WV 24801.

Completion date shall be 120 days from beginning the project, however extensions may be granted per
request due to extenuating circumstances.

One (1) set of bid documents shall be enclosed in a sealed envelope and marked visibly on the outside of
the envelope “McDowell County Premier Playground Bid”. This envelope shall be addressed to the
McDowell County Clerk’s Office, Attn.: Linda White 90 Wyoming Street Suite 109 Welch, WV 24801.

The County Commission nor the County Clerk will be responsible in the event that the U. S. Postal
Service or any other courier system fails to deliver the sealed bid to the County Clerk by the given
deadline above. No bids will be accepted via facsimile or electronic submission.

The County Commission reserves the right to reject any or all bids, to waive irregularities or informalities
in any or all bids, and to accept any bid which is deemed to be in the best interest of the County.
