The West Virginia Department of Environmental Protection, Division of Mining and Reclamation, 601 57th St. SE, Charleston, WV 25304, will hold a Show Cause Hearing starting at 9:00 am on Wednesday, September 25, 2024 on the 3rd Floor in the West Virginia Conference Room No. 3001.
The purpose of this hearing is to show cause why Permit Number U001383 located near Naoma in the District of Marsh Fork in Raleigh County issued to Lexington Coal Company, LLC. of West Virginia should not be suspended or revoked and associated securities forfeited by Harold Ward, Secretary of the West Virginia Department of Environmental Protection. This hearing was requested by Lexington Coal Company, LLC in response to Show Cause Order No. 2199. This hearing is being held in Accordance with Title 38, Legislative Rule, Series 2, Section 20.4.e. AIR QUALITY PERMIT NOTICE

Notice of Open Comment Period

On August 14, 2024, Equitrans, LP applied to the WV Department of Environmental Protection, Division of Air Quality (DAQ) for a permit to Modify and operate a Natural Gas Compressor Station located at 52 Lylac Road, Mannington in Marion County, WV at 39.523524 and -80.439804. A preliminary evaluation has determined that all State and Federal air quality requirements will be met by the proposed facility. The DAQ is providing notice to the public of an open comment period for permit application R13-3441A.

The following decrease in potential emissions will be authorized by this permit action: Particulate Matter less than 10 microns, tons per year 0.22; Particulate Matter, 0.22 TPY; Sulfur Dioxide, 0.02 TPY; Oxides of Nitrogen, 2.56 TPY; Carbon Monoxide, 2.16 TPY; Volatile Organic Compounds, 0.01 TPY; Total Hazardous Air Pollutants, 0.47 TPY.

Written comments or requests for a public meeting must be received by the DAQ before 5:00 p.m. on Friday, October 18, 2024. A public meeting may be held if the Director of the DAQ determines that significant public interest has been expressed, in writing, or when the Director deems it appropriate.

The purpose of the DAQ’s permitting process is to make a preliminary determination if the proposed construction will meet all state and federal air quality requirements. The purpose of the public review process is to accept public comments on air quality issues relevant to this determination. Only written comments received at the address noted below within the specified time frame, or comments presented orally at a scheduled public meeting, will be considered prior to final action on the permit. All such comments will become part of the public record.
