TOWN COUNCIL OF THE
TOWN OF SOPHIA, RALEIGH COUNTY, WEST VIRGINIA
PETITION FOR ANNEXATION PURSUANT TO WV CODE §8-6-4
Whereas, the Town of Sophia is a municipality within Raleigh County, West Virginia; and
Whereas, the Town of Sophia desires that the Town of Sophia annex certain tracts of land into corporate limits of the Town of Sophia and, in support thereof, declare as follows:
1. The area of land proposed to be annexed consists of three (3) tracts of approximately .96 acres, .444 acres and 6.332 acres owned by the Town of Sophia and more particularly described on the attached Exhibits A, B and C as well as the appurtenant portions of Hot Coal Road, described on the attached Exhibit D, tax map.
2. The current sewer plant and proposed upgraded sewer processing facility are located upon the property.
3. The Petitioner is the only property owner (free holders) and qualified voter within the additional territories to be annexed.
4. There are no additional individuals or businesses residing or operating in the proposed territory.
5. The Petitioner provides with this application the metes and bounds description of the territory to be annexed which describes the boundaries of the property subject to this petition and which is attached as Exhibits A, B, and C as well as map Exhibit D showing the portion of Hot Coal Road to be annexed. Said portion of Hot Coal Road to be annexed begins at the junction of Hot Coal Road with Independence Road and continues roughly southeast along the tract A where it fronts upon Hot Coal Road.
6. Petitioner requests that the Town of Sophia will provide 24 hour a day police and fire protection. On information and belief, this will not require additional staffing for said departments.
7. The annexation of the additional territory will cause no impact on any private solid waste collection service or public service district currently doing business in this territory, which are currently serving said tracts.
8. It is not anticipated that fire insurance rates and/or services will be negatively affected by the proposed annexation.
9. This Petition for annexation meets the requirements of West Virginia Code §8-6-4.
Wherefore, the Town of Sophia proposes to annex the subject properties by ordinance pursuant to WV Code §8-6-4(a) and thereafter file with the County Commission of Raleigh County, an appropriate certification of such ordinance pursuant to WV Code §8-6-4(g) in order that the Raleigh County Commission enter an order in accordance with WV Code §8-6-3.
