The object of the above-entitled action is to partition among those entitled the following described real estate situate in the City of Beckley, Raleigh County, West Virginia:
THE SURFACE of Lots nos. 89 and 90 of Map of Hedrick-Walker-Carter Addition on Cova Street, less an exception of part of Lot 90 conveyed in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 322, at Page 284.
It appearing by affidavit filed in this action that the said Darlene Frances Deluca, Anthony R. Deluca and Michael Deluca are nonresidents of the State of West Virginia; that there are or may be persons other than those named above as plaintiffs and defendants who are heirs of Frances Severino Deluca and Heirs of Debra Tucker Upegui and interested in said real estate, whose names are unknown to plaintiff, and who are made parties to the complaint filed in this action by the general description of unknown defendants; it is
Ordered that each of them do appear and serve upon Robert N. File, FILE PAYNE SCHERER & FILE PLLC, 130 Main Street, Beckley, West Virginia 25801 an answer or other defense to the complaint filed in this action on or before November 11, 2024 otherwise judgement by default will be taken against them at any time thereafter.
A copy ofsaid complaint can be obtained from the undersigned Clerk At her office located at 222 Main Street, Beckley, Raleigh County, West Virginia.
