On a prior day, to wit: December 4, 2024, this Court entered an Order granting unto the Plaintiff authority to obtain service of process upon the Defendant, Tommy Sexton DBA Sexton Home Improvements and/or DBA All Around Tree Service, a resident of the State of West Virgina by publication pursuant to West Virginia Rule of Civil Procedure 4 (e) (1).
The object of the above-named suit is to obtain money judgment against Defendant, Tommy Sexton DBA Sexton Home Improvements and/or DBA All Around Tree Service.
To Tommy Sexton DBA Sexton Home Improvements and/or DBA All Around Tree Service: It appearing by Affidavit filed in this action that Defendant, Tommy Sexton DBA Sexton Home Improvements and/or DBA All Around Tree Service cannot be located through diligent efforts and/or is evading service of civil process, and is a resident of the State of West Virginia, it is hereby ORDERED that Tommy Sexton DBA Sexton Home Improvements and/or DBA All Around Tree Service serve upon Gorman, Sheatsley & Company, L.C., P.O. Box 5518, Beckley, West Virginia 25801, an answer to this civil action including any related counterclaim or defense you may have to the Complaint filed in this action within thirty (30) days after the first publication of this Order. If you fail to do so, thereafter judgment, upon proper hearing and/or trial may be taken against you for the relief demanded in the Complaint.
A copy of the Complaint may be obtained from Counsel for the Plaintiff or the Circuit Court of Raleigh County, West Virginia at 222 Main Street, Beckley, WV 25801.
