NOTICE OF TRUSTEE’S SALE
NOTICE is hereby given that default having been made under the terms of a deed of trust dated August 1, 2003 recorded in the Office of the County Clerk of Raleigh County, West Virginia, in Book 5010 at page 4221, executed by Robert Lee Lewis and Elaine Louise Lewis to W.F. Richmond, Jr., Trustee, which was given to secure for the benefit of Joan Beckett and Ralph Beckett, 904 S. Kanawha St., Beckley, West Virginia 25801, as Beneficiaries, recorded on August 19, 2003 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5010 at page 4221, to secure the payment of the note therein described, and by Substitution of Trustee recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5073 at page 2253 the beneficial holder removed the said W. F. Richmond, Jr., as Trustee and substituted therefore Clyde A. Smith, Jr., as Trustee; and demand having been made upon the undersigned Substitute Trustee so to do, the undersigned Substitute Trustee will on the 15th day of March, 2021 at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 1:15 p.m. proceed to sell the following described real estate,
That certain lot or parcel of surface land situated in Raleigh County, West Virginia, in the City of Beckley, Tax Map 36, Parcel 244, bounded and described as follows:
BEGINNING at a stake, S.W. corner of a lot sold to P.F. Reed, and on the location of a thirty foot street, thence with his line, S. 60deg. E. 219 feet to a stake on an alley fifteen feet wide and with said alley, S. 31 1/2deg. W. 37 feet to a stake; thence S. 14 1/2deg. W. 14 feet to a stake; thence N. 60deg. W. 222 feet to said street location and with said street, 50 feet to the BEGINNING, with the address of 115 West C Street.
And being the same property heretofore acquired by Robert Lee Lewis and Elaine Louise Lewis, his wife, by Deed dated the 1st day of August, 2003 from Joan Beckett and Ralph Beckett, her husband, and recorded in Book 5010 at page 4220. Elaine Louise Lewis conveyed her one half interest to Ralph Beckett by deed dated June 17, 2015, recorded in Book 5059 at page 4020. Ralph Beckett died April 6, 2017, and by his will recorded in Book 5066 at page 0167 he devised his entire estate to Rebecca Joan Beckett-Clay, now known as Rebecca Joan Beckett Jenkins.
Said sale will be made upon the following terms and conditions:
1. Cash in hand on day of sale.
2. Property is conveyed in an as is condition by deed with special warranty of title subject to the Internal Revenue Service Right of Redemption, all property taxes, prior deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right of ways, easements, covenants, conveyances and conditions of record in the Office of the County Commission of Raleigh County or otherwise affecting the subject property.
3. The beneficial holder reserves the right to bid for the property at said sale.
4. Substitute Trustee reserves the right to continue sale on subject property from time to time by written or oral proclamation in the sole discretion of the Substitute Trustee.
5. The purchaser at the sale shall be responsible for paying the recording costs, including the excise stamp tax and recording fees.
6. In the event there are federal tax liens against the property the United States would have the right to redeem the property within a period of 120 days from the date of said sale or the period allowable for redemption under local law whichever is longer.
