NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE

Pursuant to the authority vested in the undersigned by deed of trust dated the 4th day of October, 2004, signed by John C. Persinger, to Jenny N. Phillips, Trustee, State Director of the Rural Housing Service for the State of West Virginia or its successor agency, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Raleigh, West Virginia, in Trust Deed Book 5015, at page 2366, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:30 o’clock p.m. on the

11th day of FEBRUARY 2025

at the front doors of the Courthouse in Raleigh County in Beckley, West Virginia located at 215 Main Street, Beckley, West Virginia, the following described real estate located in the District of Shady Spring, County of Raleigh, State of West Virginia as follows:

The surface of that certain tract or parcel of land situated on the Grandview Road, Shady Spring District, Raleigh County, West Virginia, and being more particularly described as being Lot No. 2 as shown on a map entitled “Map of Subdivision of Frank and Bessie Blackburn’s 25 Acre Tract, Grandview Road, Shady Spring District” which said parcel of land is more particularly described as follows:
Beginning at a stake on the northern side of the road leading from U.S. Highway 19-21 from Beaver, West Virginia, to Table Rock, West Virginia, and known as the Ridge Road, at a common corner of Lot No. 1; thence leaving the said Ridge Road, running with the common lot line of Lot No. 1 and Lot No. 2, N 18 degrees 34’ 30” W. 300 feet to a stake, at a common corner of Lot No. 1; thence N 72 degrees 13’ E 150 feet to a stake, at a common corner to Lot No. 3; thence with the common line of Lot No. 2 and Lot No. 3. S 18 degrees 34’ 30” E 300 feet to a stake on the northern side of the aforesaid Ridge Road, at a common corner to said Lot No. 2 and Lot No. 3; thence West with the said road as it meanders 150 feet to the point of beginning, containing 45,000 square feet, more or less.

And being more particularly bounded and described by more recent survey, as follows:

That certain parcel of land located near Beaver, Shady Spring District, Raleigh County, West Virginia, being Lot No. 2 of the Map of the Subdivision of the Frank and Bessie Blackburn Tract, said Lot No. 2 being bounded and more particularly described as follows:

BEGINNING at a rebar (found), being the common corner of Lots No. 1 & 2, at the boundary line of the Roy E. & Leodia Shrewsbury (MR 69 – PG 1883) tract of land, thence with the boundary line of the said Shrewsbury tract of land; N 65o 28’ 28” E 150.00’ to a rebar (found), being the common corner of Lots No. 2 &3, thence with the common lot line of Lots No. 2 & 3; S 19o 03 41” E 295.00’ to a rebar (set), a corner of Lots No. 2 & 3, at the right of way of Scott Ridge Road (WV State Route No. 307), thence with the right of way of Scott Ridge Road; S. 65o 28’ 28” W 150.00’ to a rebar (set), being a corner of Lots No. 1 & 2, thence with the common lot line of Lots No. 1 & 2; N 19o 03’ 41” W 295.00’ to the point of beginning, containing 1.011 acres, more or less, as surveyed by ESI, Inc., Beckley, West Virginia, as shown on a map entitled “Plat of Survey for John C. Persinger and Mary L. Persinger, Being Lot No. 2 of the Map of the Subdivision of the Frank and Bessie Blackburn Tract of Land, Near Beaver, Located at 1031 Scott Ridge Road ( WV State Route No. 307), Shady Spring District, Raleigh County, West Virginia, Scale 1” = 50’, Date: September 1, 2004.”

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

The above described real estate is reported to have a mailing address of:

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third-party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record. Some Trustee sales may be conducted by a servicer required Auction Company. In that event, the auctioneer will be acting under an “Auction Services Agreement.”
