Notice is hereby given that ELK RUN COAL COMPANY, LLC, PO BOX 457, 370 Packsville Marfork Road, Whitesville, WV 25209 has submitted an application to the Department of Environmental Protection (DEP) 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for a significant permit revision to Article 3 permit number U500715 in order to update the geologic information to show that the Eagle seam and its lower split will be mined along with the Little Eagle seam where geologic conditions make it feasible
The revised permit will discharge into Dow Fork of Long Branch of Clear Fork of Big Coal River of Coal River of the Kanawha River and is located 2.0 miles northeast of Dorothy in the Clear Fork District of Raleigh County, Longitude 81°24’52” and Latitude 37°57’44” (coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until May 22, 2025 or thirty (30) days from date of final publication. A copy of the application will be available for review until May 22, 2025, or thirty (30) day from date if final publication in the DEP Regional Office located at the above address and is available at:
