The object of the above-entitled action is to sell the real estate owned by decedent Sharon Harsanyi and set forth in the Petitioners’ “Petition For Partition of Real Estate By Sale and Distribution of Estate Assets”. In addition, Petitioner asserts that they are unable to locate some of the Respondents after due diligence and Petitioners move for an Order of Publication pursuant to W. Va. R. Civ. Pro. 4(e)(1)(C) so that proper notice of said “Petition For Partition of Real Estate By Sale and Distribution of Estate Assets” may be served upon the Respondents or other interested persons.
After the review of the Affidavit for Publication, this Court agrees that the Petitioners and Petitioners’ Attorney used due diligence in locating the Respondents, but was unable to locate some or all of them and that there may be other interested persons. As such, it is ORDERED that publication be made. It is further ORDERED that Respondents appear and serve upon Anna R. Ziegler, counsel for plaintiff, whose address is 110 James Street, Hinton, West Virginia 25951, an answer or other defense to the Complaint filed in this action within thirty (30) days of the first date of publication otherwise judgment by default will be taken against them.
A copy of said Petition and Motions can be obtained from the Circuit Clerk’s office located in Beckley, Raleigh County, West Virginia.
